AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING CERTAIN PROVISIONS OF PART
9.04.08.15 OF THE ZONING ORDINANCE GOVERNING THE BAYSIDE
COMMERCIAL DISTRICT TO CLARIFY THE rtEQUIREMENTS FOR SIDEWALK
CAFES, TO CLARIFY THE BUILDING STEPBACK REQUIREMENTS, AND TO
REVISE ~HE PER BLOCK LIMITATIONS ON THE NUMBER OF FOOD USES,
ALCOHOL OUTLETS AND FAST FOOD COURTS PERMITTED ~N ?HE BSC

WHEREAS,
follO'.Hng the adoptloD of U:.e Bayside D.::..strlct
Specific Plan and accompanYlng ordlnances to crea~e the BSe
Dlstrlct in January of 1996, the Clty Councll dlrected staff to
return to the Plannlng CommlSSlon and Clty Councll Wltt amendments
related to ground floor office uses and food use allocatlons; and
WHEREAS, SlDce the adoptlon of the BSC Dlstrlct standards, an
issue has been ralsed related to sldewallc cafes in the BSC-1
portlon of the BSC Dlstrlct; and
WHEREAS, the Planning CommlSSlon adopted a Resolutlon of
Intentlon on 0urce 19, 1996, to amend the BSe Dlstrlc~ standards;
and
WHEREAS, the Pla~ning COITmiSS10n held a publlC hearlng on the

Bse Distrlct standards amendments and made reco~mendatlons to the
Clty Councll followlng the hearlng; and
WHEREAS, ~ne Cl ty Ccur:cll ield a. publle hearlng on the
amendments to the BSC Dlstrlct standards; and
W~EREAS, the Clty Councll flnds and declares that the proposed
amendments to the BSC Dlstrlct standards are conslstent In
pr lnclple Wl th the goals, ab] ectl ves, pollcies, land uses, and
programs speclfled lD the adopted Gene~al Plan, ln that all of the
amendments to the BSC standards are ln compllance wlth the la~d
uses and developrr-ent standards allowed ln the Downtown Co~,erclal
District of the Land Use Element of the General Plan; and
WHEREAS, the publlC health, safety, and general welfare
requlre the adoption of the proposed amendment In that the
amendments wlll ensure that sldewalk cafes are properly regulated,
adequate bUlldlng stepbacks are provlded, and the number of food
uses, fast foed food ceurts, and alcohol outlets are llffilted ln
order to prevent an undue concentratlon of such uses ln the
downtm.;n area;

(c) MlnlIum Parce: Size. For all ZOTIlng classifications
In the BSC D1str1ct, mlninum parcel Slze shall be seven thousa~d
f1 ve hundred square feet. Each parcel shall contaln a mlnlmum
depth of one hundred f1fty feet and a m1n1mum width of f1fty feet,
except that legal parcels eXlstlng on the effectlve date of thlS
Section shall not be subJect to this requlrement.
(d) For all zonlng classlf1ca~lons ~n the BSC D1str~ct,
a Developmen~ ReV1ew Permlt 1S required for any new development of
more than thlrty thousand square feet of floor area and for any
development wlth rooftop park1ng.

Sectlon 9.04.08.15.080 of tne Santa Maraca
Municipal Code is amended to read as follows:
9.04.08.15.080. Llmltatlons on food uses and alcohol outlets.
(a) The nu~ber of alcohol and food serv1ng

establishments 1n the sse D1str1ct shall be lim1ted. For purposes
or th1S sect1on, a food serv1ng establishment shall 1ilclude any
restaura~t, 1Dcludlng, w1thouL 1~nltat1on, any dr1ve-thro~gh or
dr1ve-1n resta~rant, fast-food or ta~e-out resta~rant, or sldewa~k
cafe, and any use Wh1Ch 1ncludes 1ncloental food serV1ce. The
number of food serv1ng establlshmen~s and on-sale alcohol outlets
in the ESe Dis~r~ct shall not exceed the 11mitations below. for
purposes of th1S sect1on, fast food food courts shall be counted as
one food servlng establ1sh~ent and one alcohol ou~le~, even though
individua~ tenants wlth1n a fast food :ood court may be requ1red to
obtain separate Cond~t1onal Cse Perm1ts In order to obta1n an on-
sale alcohol llcense. The total number of food serv1ng
establ1shnents and alcohol outlets ~~ the BSe J~str1ct shall be
llffi1ted to seventy-s1x (76) food serv1ng establ1shme~ts, f1fty (50)
of wh~ch may have a type 41 (on-sale beer and W1ne) or type 47 lon-
sale general) alcohol llcense. No alcohol outlets Wh1Ch are not
also food serving establlshments shall be allowed. Add1tlonally,
the nlli~er of food servlng establ1shments and alcohol outlets on
Block 4, Block 5 and Block 6 shall be limlted as follows:

the provlSlon of this Ordlnance.
SECTION 5. If any section, subsectlon, sentence, clause, or
phrase of this Ordlnanee is for any reason held to be lnvalld or
unconstltutlonal by a declslon of any court of competen~
]urlsdlctlon, such deC1Slon shall not affect the valldlty of the
remainlng portior.s of ttlS Ordinance.

declares that It would have passed thlS Ordlnance, and each and
every sectlon, subsectlon, sentence, clause, or phrase not declared
invalld or unconstltutlonal wlthout regard to whether any port~on
