O1815 . e CA:f:\atty\muni\laws\mhs\skate city council Meeting 9-26-95 santa Monica, California ORDINANCE NUMBER 1815 (CCS) (City council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING MUNICIPAL CODE SECTION 9.04.08.64.040 REGARDING CONDITIONALLY PERMITTED USES IN THE R3R ZONING DISTRICT WHEREAS, an application was filed to amend the Zoning Ordinance to allow bicycle and skate rental stores as conditionally permitted uses in the R3R zoning district; and WHEREAS, the Planning Commission held a public hearing on the proposed amendment and made recommendations to the City Council following the hearing; and WHEREAS, the Ci ty Council held a public hearing on the proposed amendment on September 12, 1995; and WHEREAS, the City Council finds and declares that the proposed amendment is consistent in principle with the goals, objectives, policies, land uses, and programs specified in the adopted General Plan, specifically the following: Objective 1.5 which states that the City should encourage the expansion of "visitor accommodations and related uses in the Oceanfront area, while protecting the 1 . e residential mix;" Proposition S which does not prohibit visitor serving retail uses if such uses are permi tted in the subj ect District; Goals 3,4, and 6 related to the encouragement of coastal-dependent development which provides recreational opportunities; and General policies 31 and 35 which encourage visitor serving recreation uses, particularly those of relatively low cost; and WHEREAS, the public health, safety, and general welfare require the adoption of the proposed amendment, in that the proposal allows the retention of a small visitor serving use which complies with the General Plan and is in keeping with the mixed use character of the neighborhood, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. section 9.04.08.64.040 of the Santa Monica Municipal Code is amended to read as follows: 9.04.08.64.040 Conditionally permitted uses. The following uses may be perIni tted in the R3R District subject to the approval of a Conditional Use Permit: (a) Bed and breakfast facilities. 2 . e (b) Boarding houses. (c) Child day care centers. (d) Community care facilities. (e) Places of worship. (f) Homeless shelters. (g) Neighborhood grocery stores. (h) Offices and meeting rooms for charitable, youth, and welfare organizations. (i) One story accessory buildings over fourteen feet in height or two story accessory buildings up to a maximum height of twenty-four feet. (j) Residential care facilities. (k) Rest homes. (1) Schools. (m) Underground parking structures provided the parcel was occupied by a surface parking lot at the time of adoption of this Chapter, the parcel is not adjacent to a parcel in the C2 District, the ground level above the underground parking structure is used for residential or public park and open space uses, the structure is associated with an adjacent commercially zoned parcel, and the vehicle access to the underground parking is from the commercially zoned parcel and as far 3 . e from the residentially zoned parcel as is reasonably possible. (n) Bicycle and skate rental facilities. SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto, inconsistent with the provisions of this ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconsti tutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. 4 . e SECTION 4. The Mayor shall sign and the city Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause this ordinance, or a summary thereof to be published once in the official newspaper within 15 days after its adoption.
