O1799 e e CA:f:\atty\muni\laws\mhs\mlrdmap city Council Meeting 5-9-95 Santa Monica, California ORDINANCE NUMBER 1799 (CCS) (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING THE OFFICIAL DISTRICTING MAP TO ESTABLISH THE LIGHT MANUFACTURING AND STUDIO DISTRICT IN PORTIONS OF THE FORMER M1 AND C5 DISTRICTS WHEREAS, concurrently with adoption of this amendment to the Official Districting Map to establish the Light Manufacturing and Studio District ("LMSD District") in portions of the former M1 and C5 Districts, the City Council is adopting an amendment to the Zoning ordinance to establish authorized uses and property development standards for the LMSD Districtj and WHEREAS, the city Council finds and declares that the proposed amendment to establish the LMSD District in portions of the former M1 and C5 districts is consistent in principle with the goals, objectives, policies, land uses, and programs specified in the adopted General Plan, in that, consistent with Land Use and Circulation Element Policies for the special Office District and Objective 1.B, the development standards and permitted uses designated for the LMSD District further the goal of accommodating advanced technology uses which require large floor area, while recognizing that the goal of accommodating large scale general 1 e e office development has been accomplished through retaining designated parcels subject to development agreements in C5 zoning designations; and consistent with Objective 1.9, the development standards and permitted uses designated for the LMSD District further the goal of preserving existing and accommodating future industrial and manufacturing uses in the area; and WHEREAS, the public health, safety, and general welfare require the adoption of the proposed amendment, in that the LMSD District standards set appropriate limits to development in the area, in order to allow growth in amounts sufficient to keep the city fiscally sound, and at a level that will protect the health and welfare of city residents and maintain quality of life standards; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. The Official Districting Map of the city is that set forth in Exhibit itA." SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto, inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance. 2 e e SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconsti tutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The city Council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence I clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. SECTION 4 . The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper wi thin 15 days after its adoption. This Ordinance shall be effective 30 days from its adoption.
