O1789 e e CA:f:\atty\muni\laws\mjm\facfee City Council Meeting 2-28-95 Santa Monica, California ORDINANCE NUMBER 1789 (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTION 6.70.040 TO MODIFY THE DUE DATES FOR THE REPORTS AND TAX REMITTANCES REQUIRED BY THE PARKING FACILITY TAXES LAW THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN AS FOLLOWS: SECTION L Municipal Code section 6.70.040 is amended to read as follows: 6.70.040. Reports and tax remittance. (a) The person or operator collectl.ng or obligated to collect any parking facility tax pursuant to this chapter shall prepare a report upon a form prescribed by the Director of Finance. The report shall include the amount of parking fees collected and the amount of the tax collected pursuant to thl.s Chapter. Additionally, the report shall include such information as is required by the Director of Fl.nance to carry out the purposes of this Chapter. 1 e e (b) The person or operator collecting or obligated to collect any parking facility tax shall remit to the City the parking facility tax together with the report prepared pursuant to Subsection (a). (c) The reports and tax remittances of parking facility taxes shall be delinquent if not paid on or before the twenty-fifth day following the end of each reporting quarter as specified hereln, and shall cover the reporting quarter just ended. For purposes of this Chapter, the reporting quarters are as follows: December 1st through February 28th/29th, March 1st through May 31st, June 1st through August 31st, September 1st through November 30th. SECTION 2. Any provis1on of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ord1nance is for any reason held to be invalid or unconstitutional by a decision of any court of competent 2 e e Jurisdiction, such decision shall not affect the validity of the remal.ning portions of this Ordinance. The city Council hereby declares that it would have passed this Ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the city Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effect love 30 days from its adoptl.on.
