O1409 .. e CA:RMM:rmd478/hpca city council Meeting 6-9-86 e santa Monica, California ORDINANCE NUMBER ~ (City council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING ZONING DISTRICT AMENDMENTS 26 AND 27 WHICH AMEND THE DISTRICTING MAP TO CHANGE THE ZONING OF VARIOUS PROPERTIES IN THE CITY OF SANTA MONICA THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council finds and declares: (a) On July 31, 1986, st. John's Hospital and Health center/Sisters of Charity of Leavenworth Health Services Corporation filed two applications for zone change pursuant to Santa Monica Municipal Code section 9149 requesting that the properties located in the block north of Arizona Avenue between 21st Street and 22nd Street be reclassified from Commercial-Professional Office District ("Cpl1) to R-2 Multiple Residential District ("R2") (Zoning District Amendment 26) and that the properties located on the west side of 23rd Street between Arizona Avenue and Santa Monica Place alley (on the 1300 block of 23rd street) be reclassified from R2 to CP (Zoning District Amendment 27). (b) On August 14, 1986, st. John's Hospital and Health center/Sisters of Charity of Leavenworth Health Services Corporation filed an application pursuant to Santa Monica - 1 - e e Municipal Code Section 9149 requesting an amendment of the Land Use Element of the General Plan ("GPA-04t1) that would reclassify all "Low Density Housing" District properties on the west side of 23rd Street between Arizona Avenue and Santa Monica Place alley to the "Institutionsfl District. (c) On March 2, 1987, the Planning commission held a public hearing to consider Zoning District Amendments 26 and 27, GPA-04 and the Environmental Impact Report on the proposed changes (EIA-828) as required by Santa Monica Municipal Code Section 9149C(3) and voted to forward a recommendation that the City Council certify the proposed amendments and the Environmental Impact Report. Cd) On April 20, 1987, pursuant to Santa Monica Municipal Code section 9413, the Planning commission adopted Resolution Number 87-004 (PCS) approving GPA-04. (e) After considering the Planning Commission's written findings and recommendations, on April 28, 1987, the City Council adopted Resolution Number 7420 (CCS) certifying EIA-828 and Resolution Number 7421 (CCS) approving GPA-04. (f) On May 15, 1987, pursuant to Santa Monica Municipal Code section 9149C.2.a., a notice of public hearing on an ordinance adopting Zoning District Amendments 26 and 27 was published in the Santa Monica Evening Outlook. (9) On May 26, 1987, the City council opened the a public hearing to consider adoption of Zoning District Amendments 26 and 27 which amend the Distrlcting Map and change the zoning of certain properties in the city and continued the hearing until June 2, 1987. - 2 - e e (h) On June 2, 1987, the City council held a public hearing to consider adoption of Zoning District Amendments 26 and 27. (i) The city council finds that the public convenience, general welfare, and good zoning practice requires that the zone changes proposed in Zoning District Amendments 26 and 27 be adopted. SECTION 2. The Districting Map, which is attached to and made a part of Chapter 1, Article IX, Section 9103 of the Santa Monica Municipal Code, is hereby amended so that said Map designates the following described properties as uR2 It Multiple Residences District: Lots 22, 23, 24, 28, 29, and 30 of Tract 199 in the city of Santa Monica, more commonly known as 1247-1251 21st street and 1246 22nd Street. SECTION 3. The Districting Map, which is attached to and made a part of Chapter 1, Article IX, Section 9103 of the Santa Monica Municipal Code, is hereby amended so that said Map designates the following described properties as I1cpn commercial-Professional Office District: Lots 19 through 29 of Tract 4618 in the city of Santa Monica, more commonly known as 1302 through 1342 (even numbers) 23rd Street. - 3 - e e SECTION 4. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the provisions of this Ordinance. SECTION 5. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The city Council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. SECTION 6. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effective after 30 days from its adoption.
