O1342 - e RMM:LL:JH:llo003a Clty Council Meeting 8-13-85 Santa MonIca, CalIfornia ORDINANCE NUMBER l342(CCS) (CIty CouncIl SerIes) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING THE DISTRICTING MAP WHICH IS A PART OF CHAPTER 1, ARTICLE IX, SECTION 9103 OF THE SANTA MONICA MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. FindInas. The CIty CouncIl fInds and declares: (a) On May 8J 1985, an application for zone change was flIed pursuant to Santa Monica MunIcipal Code SectIon 9149 by a record owner of property requestIng that the existing zonIng on SIX lots, lncludIng that of the applIcant, be changed from R-1A to R-1. (b) On June 3, 1985, the PlannIng CommIssion opened a publIC hearing on the applIcatIon, WIthIn thIrty days of applIcatIon fIlIng as requIred by Santa Monica MunICIpal Code SectIon 9149C(3). The publIC hearIng was contInued to June 17, 1985 (c) On June 17, 1985, the PlannIng CommISSIon concluded the publIC hearIng and adopted a motion with fIndIngs recommendIng that the City CounCIl approve the requested zone change. The PlannIng CommISSIon's deCIsion was rendered 1 e e withIn the forty (40) day tIme perIod specIfied by MunicIpal Code SectIon 9149C(3), and a copy of this recommendation was transmItted to the applIcant on June 18, 1985. (d) After conSIderIng the Planning CommissIon's written fIndIngs and recommendatIon, the CIty CounCIl also fInds that the public convenIence, general welfare, and good zonIng practIce reqUIres that the proposed zone change be made. SECTION 2. DIstricting Map ~mended. The Districtlng Map WhICh IS attached to and made a part of Chapter 1, ArtIcle IX, SectIon 9103 of the Santa MonIca MunIcipal Code ]s hereby amended so that saId Map deSIgnates the follOWIng descrIbed propertIes as "Rl" One-Family ReSIdentIal District: Lot 153, Tract 2385 (1157 FranklIn Street) Lot 152, Tract 2385 (1155-67 FranklIn Street) Lot 239, Tract 2385 (1160 Centlnela Avenue) Lot 240, Tract 2385 (1166 Centinela Avenuel Lot 247, Tract 2385 (1165 CentInela Avenue! Lot 248, Tract 2385 (1159 Centinela Avenue) SECTION 3. Inconsistent prOVISIons. Any provision of the MunICIpal Code or appendices thereto inconSIstent WIth the prOVISIons of thIS ordInance, to the extent of such inconSIstencIes and no further, is hereby repealed or modIfied 2 e e to the extent necessary to effect the provisions of this ordInance. SECTION 4. Severab1l1tv. If any sect1on, subsection, sentence, clause, or phrase of th1S ordinance 1S for any reason held to be Invalld or unconstItutIonal by a deCISIon of any court of competent jurIsdict1on, such decision shall not effect the valIdIty of the remalnIng port1ons of the ordInance The City CounCIl hereby declares that It would have passed thlS ordinance and each and every sectIon, subsection, sentence, clause or phrase not declared invalId or unconstItutional WIthout regard to whether any portIon of the ordInance would be subsequently declared invalid or unconstitutIonal. SECTION 5. ExecutIon. The Mayor Shall sign and the City Clerk shall attest to the passage of this ordinance. The CIty Clerk shall cause the same to be publIshed once In the offICIal notIces sectIon of the local general CIrculation newspaper wIthln flfteen (is) days after its adoptIon.
