AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADOPTING THE
SANTA MONICA SIGN CODE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN
AS FOLLOWS:
SECTION 1. Chapter 9 is hereby added to Article IX of
the Santa MonIca Municipal Code to read as follows:
Chapter 9--Santa Monica Sign Code
Section 9900. Siqn Code. The
Uniform Sign Code, 1982 Edition, three
copies of which are on file In the
office of the City Clerk for use and
examination by the public, is hereby
adopted as the structural sign code
for the City of Santa Monica and shall
be referred to, together with all
sections of of this Chapter, as the
Santa Honica Sign Code.
If there is
any conflict between the provisions of
the Uniform Sign Code, 1982 Edition,

and this Chapter, the provisions of
this Chapter shall control.
Section 9901. Findincs and
Puroose. The City Council finds and
declares:
(a) An excess of large, ugly,
intense signs causes a visual blight
on the appearance of the City by
detracting from views of structures
and open space. This visual blight
adversely affects the aesthetic
quality of life and traffic safety in
Santa Monica for residents,
businesses, pedestrians, and persons
in vehicles. In order to promote the
appearance of the City, while
protecting the rights of sign owners
to expression and identification, the
regulation of existing and proposed
signs is necessary to protect the
publlC health, safety, and general
welfare.
(b) The purpose of the Santa
Monica Sign Code is to encourage signs
which are integrated with and
harmonious to the buildIngs and sites
which they occupy, to eliminate

excessive and confusing sign displays,
to preserve and improve the appearance
of the city as a place in which to
live and to work and as an attraction
to non-residents who come to visit or
trade, and to restrict signs which
lncrease the probability of accidents
by distracting attention or
obstructing vision.
(c) The Santa Monica Sign Code
provides minimum standards to
safeguard life, safety, property and
public welfare by reviewing design and
by regulating size, construction,
location, electrification, operation
and maintenance of all signs and sign
structures exposed to public view
within the City. The visual
appearance and traffic safety of the
City cannot be achieved by measures
less restrictive than the procedures
and standards of this Chapter.
(d) It is the intent of the
City to regulate signs consistent with
California BUSIness & Professions Code
Section 5490-5497 to the maximum
extent permitted by State law.

Section 9902. Definitions. The
following words and phrases as used in
the Santa Monica Sign Code shall have
the folowing meanings:
C.) Abandoned Sian. A sign
which no longer advertises or
identifies a legal business
establishment, product or activity.
(b) Alteration. Any change in
copy, color, size or shape, which
changes appearance of a sign, or a
change in position, location,
construction or supporting structure
of a sign, except that a copy change
on an attraction or reader board is
not an alteration,
(cl Animated Sian. Any sign
which has any VisIble moving part,
flashing or oculating lights, visible
mechanical movement of any des-
cription, or other apparent visible
movement achieved by any means.
Cd) Area of Sian. The area
included within the outer dimensions
of a sign. On signs with more than
one face, that face or those faces
visible from anyone direction at one
time will be counted at 100% of

"exit," and the like, but does not
contain brand, trade, or business
identification and is designed to be
viewed on-site or adjacent to the site

(0) Emitting Sian. A sign
which emits sound, odor, or visible
matter such as smoke or steam.
(p) Free Standina Sian. Any
sign which is permanently affixed in
or upon the ground, supported by one
or more structural members, with air
space between the ground and the sign
face.
(q) Grade. The level of the
site at the property line located at
the closest distance to the sign.
(r) Ground SiQn. Any sign
which is neither attached to nor part
of a structure and which is
permanently affixed in or upon the
ground wi th no air space between the
ground and the sign face.
( s ) Hiah Rise Sian. Any sign
located on a building four or more
stories in height that is between the
top of the parapet or high point of
the building, exclusive of penthouse
structures, and the horizontal line
not more than 15 feet below the top of
the parapet or highpoint of the
building on the side of the building
to which the sign is affixed.

temporary or non-permanent sign
advertising or pertaining to any
civic, patriotic or special event of
general public interest.
(uu) Statue. A three-dimen-
sional representation, including a
sculpture. A statue that is related
to the advertisement of any product or
service or the identification of any
business is a sign.
(vv) SUDer GraDhic. A painted
deslgn which covers all or a major

Section 9903. Sian Permit. In
addition to any other permit required
by this Code, a sign permit shall be
obtained from the Architectural Review
Board prior to placing, changing,
altering, or displaying any sign
unless specifically exempted by this
Code. No sign permit shall be
required where the only work to be
performed is the repair, maintenance,
or replacement of a lawful and
conforming sign, the repair or
maintenance of a lawful non-conforming
sign, or the replacement or repair of
a destroyed sign except when such sign

tural Review Board shall certIfy the

Section 9915. Total SIan Area
Permitted By D\strlct.
(a) The total sign area factors
set forth 1n this SectIon govern the
aggregate square footage of all
non-exempt signs exte~nally placed or
externally viSIble at a given SIte.
The factors are related to the
building or store frontage measured
along the site street address.
(b) The total operatIve
frontage dImension for structures
located on a street corner sIte is 1.5
times the building's address frontage.
For such corner locations, no more
than two-thirds of the total allowable
sign area shall be permitted facing on
one or the other street.
(c) For all multiple-use
bUIldings in commercially or
IndustrIally zoned districts, the size
of SIgns pertaInIng to each business
or use is governed by that portion of
the building frontage occupIed by that
business or use; the total sign
program is governed by the total
building frontage. If 1n additIon to
any entrance from public streets there

permits required hereln, the erectlon,

sign within or at the recognized

Chapter w1thin 15 years from the
effectIve date of th1s Chapter.
Ce} Notwithstanding any other
provisIon of this Sectlon, any noncon-
formlng sign that would otherwIse be
prohibited by thIs Chapter shall be
removed or modlfied to conform to the
requirements of this Chapter upon any
of the followin9~
(1) If the owner, outside of a
change 1n copy, requests permlss10n to
remodel a sign, 1ncluding the
replacement of electrical parts and
tubing of a neon sign involving a
change in the external appearance or
intensity of illumination of the slgn,
or expands or enlarges the bUIlding or
land use upon which the sign is
located, and the s1gn is affected by
the constructlon, enlargement, or
remodel1ng, or the cost of
constructIon, enlargement, or
remodeling of the slgn exceeds 50
percent of the cost of reconstruction
of the building. For purposes of thiS
subdivision, remodel does not include
normal repair or maintenance of a
81g0.

(9) An extenslon of time to
remove or modify any nonconforming
sign subject to this Section may be
requested by filing an appl1cation on
the form approved by the Secretary of
the ~rchitectural ReV1ew Board and 1n
accordance with the procedures for a
sign permit applicat1on. The appli-
cation may be granted only upon a
finding that the tlme for removal or
modification set forth 1n this Section
does not provide for a reasonable
amortization period commensurate with
the investment involved. An
applicatIon for an extension under
this subdivision shall be made wIthin
two years after the effectIve date of
this Chapter.
(h) Notwithstand1ng any other
proviSIon of this Section, th1S
Sect10n shall not apply to any sign
that may not be removed pursuant to
the provisions of Business and
Professions Code SectIon 5412.5 but
only during the period of time that

and authority to revoke any sign
permit granted hereunder if the sign
does not meet all specificat10ns or

permit application and on the approved
plans.
Section 9922. Enforcement.
(a) The Building Officer and

Any such sIgn not removed or modifIed
within the required perIod shall be
considered as abandoned and shall be
removed by the Building OffIcer in
accordance wIth the abatement
procedures set forth in either Section
7800 or Section 8102 of this Code.
Cd) Any non-conformIng signs
pertainIng to enterprIses or occupants
that are no longer utIlizing the sIte
shall be removed from the site upon
the expiratIon of 90 days after the
associated enterprIse or occupant has
vacated the premIses. Any such sIgn
not removed within the required period
shall be considered as abandoned and
shall be removed by the BUIlding
OffIcer in accordance with the
abatement procedures set forth in
either Section 7800 or Section 8102 of
th~8 Code.
(e) A sign removed by the City
shall be held for not less than 30
days by the CIty durIng which time it
may be recovered by the owner upon
payment to the C~ty for removal and
storage costs. If not recovered prior

sale of unclaimed property. The
proceeds of the sale, less removal,
storage, and sale costs, shall be paid
to the owner thereof.
(f) The provisions of thiS
Section may be utilized separately
from, as an alternative to, in
additIon to, or in conjunction with
any other remedy prOVIded by law.
Section 9923. Sign Handbook.
Within six months after the effective
date of this Chapter, the
Arch1tectural ReVIew Board shall
prepare, and the Planning Commission
shall approve, a handbook for
distribution to the public on the
requirements of thiS Chapter.
SECTION 2. Chapter 5 of ~rticle VIII of the Santa
Monica Municipal Code is repealed in its entirety.
SECTION 3. Any provision of the Santa Honica Municipal
Code or appendices thereto inconsistent With the provIsions of
this ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modified to that extent
necessary to affect the prOVIsions of this ordinance.

SECTION
4.
If any section, subsection, sentence,
clause, or phrase of thlS ordinance is for any reason held to
be invalid or unconstitutional by a decision of any court of
any competent Jurisd1ct1on, such deC1Slon shall not affect the
validity of the remainlng portions of the ordinance. The City
CounC11 hereby declares that it would have passed th1s
ordinance and each and every section, subsection, sentence,
clause or phrase not declared invalid or unconstitutlonal
without regard to whether any portion of the ordinance would
be subsequently declared invalid or unconstltutional.
SECTION 5.
The Mayor shall sign and the City Clerk
shall attest to the passage of thlS ordinance. ThlS City
Clerk shall cause the same to be published once in the
official newspaper w1thin 15 days after its adoption. The
ordinance shall become effective after 30 days from its
adopt1on.
