O1333 . - CA:RHH:SSS:ms:sssignS Clty Council Meeting 3-12-85 Santa Monica, California ORDINANCE NUMBER 1333(CCS) (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING THE SANTA MONICA SIGN CODE THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 9 is hereby added to Article IX of the Santa MonIca Municipal Code to read as follows: Chapter 9--Santa Monica Sign Code Section 9900. Siqn Code. The Uniform Sign Code, 1982 Edition, three copies of which are on file In the office of the City Clerk for use and examination by the public, is hereby adopted as the structural sign code for the City of Santa Monica and shall be referred to, together with all sections of of this Chapter, as the Santa Honica Sign Code. If there is any conflict between the provisions of the Uniform Sign Code, 1982 Edition, 1 e e and this Chapter, the provisions of this Chapter shall control. Section 9901. Findincs and Puroose. The City Council finds and declares: (a) An excess of large, ugly, intense signs causes a visual blight on the appearance of the City by detracting from views of structures and open space. This visual blight adversely affects the aesthetic quality of life and traffic safety in Santa Monica for residents, businesses, pedestrians, and persons in vehicles. In order to promote the appearance of the City, while protecting the rights of sign owners to expression and identification, the regulation of existing and proposed signs is necessary to protect the publlC health, safety, and general welfare. (b) The purpose of the Santa Monica Sign Code is to encourage signs which are integrated with and harmonious to the buildIngs and sites which they occupy, to eliminate 2 ,J. 4.dl _ J >€"... (c) The Santa Monica Sign Code provides minimum standards to safeguard life, safety, property and public welfare by reviewing design and by regulating size, construction, location, electrification, operation and maintenance of all signs and sign structures exposed to public view within the City. The visual appearance and traffic safety of the City cannot be achieved by measures less restrictive than the procedures and standards of this Chapter. The following words and phrases as used in the Santa Monica Sign Code shall have the folowing meanings: C.) Abandoned Sian. A sign which no longer advertises or identifies a legal business establishment, product or activity. (b) Alteration. Any change in copy, color, size or shape, which changes appearance of a sign, or a change in position, location, construction or supporting structure of a sign, except that a copy change on an attraction or reader board is not an alteration, (cl Animated Sian. Any sign which has any VisIble moving part, flashing or oculating lights, visible mechanical movement of any des- cription, or other apparent visible movement achieved by any means. Cd) Area of Sian. The area included within the outer dimensions of a sign. A sign which emits sound, odor, or visible matter such as smoke or steam. (p) Free Standina Sian. Any sign which is permanently affixed in or upon the ground, supported by one or more structural members, with air space between the ground and the sign face. (q) Grade. The level of the site at the property line located at the closest distance to the sign. (r) Ground SiQn. Any sign which is neither attached to nor part of a structure and which is permanently affixed in or upon the ground wi th no air space between the ground and the sign face. ( s ) Hiah Rise Sian. Illegal sign shall also mean any sign placed contrary to the terms or time limits of any permit and any non-conforming sign which has not been brought into compliance with the provisions of Sections 9920 and 9921 of this Chapter. Any sign for which an artificial source of light is used in order to make readable the sIgn's message, including internally and externally lighted signs and reflectorized, glowing or radiating signs. (9) An extenslon of time to remove or modify any nonconforming sign subject to this Section may be requested by filing an appl1cation on the form approved by the Secretary of the ~rchitectural ReV1ew Board and 1n accordance with the procedures for a sign permit applicat1on. The appli- cation may be granted only upon a finding that the tlme for removal or modification set forth 1n this Section does not provide for a reasonable amortization period commensurate with the investment involved. (a) The Building Officer and Zon1ng Inspector are hereby granted the power and authority to issue a Notice of Violation to the sign owner or to the sign owner's agent or manager for any sign maintained 1n v1olation of any provision of this Chapter. Within six months after the effective date of this Chapter, the Arch1tectural ReVIew Board shall prepare, and the Planning Commission shall approve, a handbook for distribution to the public on the requirements of thiS Chapter. SECTION 2. Chapter 5 of ~rticle VIII of the Santa Monica Municipal Code is repealed in its entirety. SECTION 3. If any section, subsection, sentence, clause, or phrase of thlS ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent Jurisd1ct1on, such deC1Slon shall not affect the validity of the remainlng portions of the ordinance. The City CounC11 hereby declares that it would have passed th1s ordinance and each and every section, subsection, sentence, clause or phrase not declared invalid or unconstitutlonal without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstltutional. SECTION 5. The Mayor shall sign and the City Clerk shall attest to the passage of thlS ordinance. ThlS City Clerk shall cause the same to be published once in the official newspaper w1thin 15 days after its adoption.
