AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SECTION 6623A
OF THE SANTA MONICA MUNICIPAL CODE RELATING
TO CABLE TELEVISION UTILITY USERS TAX
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN
AS FOLLCMS:
SECTION 1. Section 6623A of the Santa Monica MuniClpal
Code lS amended to read as follows:
SECTION 6623A. Cable Television.
{a) Commencing on January I, 1984,
there lS hereby imposed a tax upon every
person in the Clty of Santa Monica using
ln the City a cable television service.
The tax imposed by this Section shall be
flve per cent (5%) of the charges made for
such cable televlsion service and shall be
paid by the person paYlng for such cable
televislon service.
(b) For purposes of this Section,
cable television SerVlce shall mean a
television signal dellvered by cable for a
fee or charge.

SECTION 2. Any provision of the Santa Monica Municlpal
Code or appendices thereto lnconsistent with the provisions of
this ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modified to that extent
necessary to affect the provislons of this ordlnance.
SECTION
3.
If any section,
subsection,
sentence,
clause, or phrase of this ordlnance is for any reason held to
be invalid or unconstltutional by a deC1Slon of any court of
any competent jurisdiction, such decision shall not affect the
validity of the remalning portions of the ordinance. The City
Council hereby declares that it would have passed this
ordlnance and each and every section, subsection, sentence,
clause or phrase not declared invalld or unconstitutional
wlthout regard to whether any portion of the ordinance would
be subsequently declared invalid or unconstitutional.
SECTION 4.
The Mayor shall sign and the Clty Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be publlshed once in the officlal
newspaper withln 15 days after its adoption. The ordlnance
shall become effectlve after 30 days from its adoptlon.
