O1322 ""-... ~ e . ~ CA: RHM: rm5227ca City Council Meeting 12-11-84 Santa Monlca, Callfornia ORDINANCE NUMBER 1322(CCS) (CIty Councll Serles) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SECTION 5227C OF THE SANTA MONICA MUNICIPAL CODE RELATING TO POINTS OF COLLECTION OF REFUSE THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 5227C of the Santa Monica Municlpal Code 1S amended to read as follows: SECTION 5227C. POlnts of Collectlon of ~efuse. Any refuse placed for collectIon shall not be placed for collectIon in that portIon of any street or alley abutting on property other than the property owned or controlled by the person placing the refuse. On other than collectlon days, when refuse collections are made from the street, containers shall be stored on private property no closer than 10 feet from the street rIght-of-way lIne, unless the contaIners are stored in an 1 '\.- ~ e . enclosure. Where there 1S a public alley along which refuse collect1ons are made, all refuse shall be placed for collection upon prlvate property with1n 10 feet of the alley, prov1ding there shall be no obstructions between such refuse and the alley property line. In the event there IS not suffiCient unobstructed area In which to place refuse on such prlvate property, refuse may be placed so as not to encroach upon a publiC alley more than four feet. If there IS no publIC alley, refuse contaIners shall be placed for collection on the parkway not more than four feet from the curb. If a property owned or controlled by the person placlng the refuse IS located such that no portion of the property abuts the publIC alley or street along WhICh refuse collectlons are made, the DIrector of General SerVlces shall determlne a locatlon In the publIC alley or parkway on which the 2 , ~ e . property owner shall place the refuse conta1ners. The locat1on determined by the D1rector of General SerV1ces shall 1n no event encroach upon ~he publ1C alley more than four feet nor shall be placed more than four feet from the curb when the locat1on of the refuse conta1ners is determ1ned to be a parkway. Refuse conta1ners shall not be placed for collect1on earl1er than 4:00 p.m. a day before collection day and not later than 6.00 a.m. on the day of collect1on. Refuse conta1ners placed upon a publ1C street or alley for collection shall be removed therefrom not later than 8:00 p.m. on the day of collect1on. No refuse containers shall be placed on any publIC rlght of way on other than collectlon days w1thout a permlt having been obtalned from the Dlrector of General Services 1n accordance With Sectlon 7151 of thls Code. 3 e . Class B rubbish not In a container shall be placed on the parkway, and shall nelther extend Into the street nor be placed on any portion of a parkway used as a sidewalk. Refuse from a corner lot, If there IS no alley, may be placed In accordance wlth provlslons of this section on any frontage along which refuse collectlon trucks are routed, provided all refuse from such lots shall be placed for collections at one place. SECTION 2. Any provlslon of the Santa Monlca Munlcipal Code or appendices thereto Inconslstent with the provisions of thls ordlnance, to the extent of such Inconslstencles and no further, are hereby repealed or modifled to that extent necessary to affect the prOVISions of thls ordlnance. SECTION 3. If any section, subsection, sentence, clause, or phrase of thls ordinance is for any reason held to be lnvalid or unconstitutional by a deciSlon of any court of any competent Jurlsdlctlon, such decision shall not affect the valldity of the remalning portions of the ordinance. The City Council hereby declares that It would have passed thls ordlnance and each and every sectlon, subsectlon, sentence, clause or phrase not declared lnvalld or unconstltutional 4 e . wlthout regard to whether any portlon of the ordinance would be subsequently declared lnvalld or unconstitutlonal. SECTION 4. The Mayor shall sign and the Clty Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the officlal newspaper withln lS days after Its adoption. This ordinance shall become effective after 30 days from Its adoption.
