NG ZONE C BY ADDING HILL STREET BETWEEN THIRD AND FOURTH STREETS WHEREAS, the C1ty Council has adopted Mun1cipal Code Section 3232c establishing a preferential parking zone in the area bounded by Ocean Park Boulevard on the north, Third Street on the east, the city limits on the south, and Main Street on the west; and WHEREAS, a petition has been received to enlarge the preferential parking zone to include Hill Street between Third Street and Fourth Street: and WHEREAS, the petltlon has been verified to be signed by res~dents liv1ng in two-thirds of the dwelling units comprising not less than 50 percent of the developed frontage of the proposed preferentlal parking zone: and WHEREAS, the Parking and Traffic Englneer has undertaken such studies and surveys deemed necessary to determlne Whether a preferentlal parklng zone should be designated in the area: and 1 - e WHEREAS, the C1ty Council is satisfied that the proposed area meets the des1gnation criter1a set forth in Municipal Code Section 3232A, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. amended Section 3238c is! added to the Santa Monica Mun~cipal Code to read as follows: Section 3238c. Preferent1al Parking Zone C. ( a) The followi ng named and descr1bed streets or port1ons of streets w1.thin the City shall constitute Preferential Parking Zone C: Second and Th1rd Street between Ocean Park Boulevard and the south city limits, Hill Street between Main Street and Fourth Street, and Beach Street, Ashland Avenue, and Marine Street between Main Street and Th1.rd Street, excepting therefrom the portion of any such street d1.rectly adJacent to a school, church, or licensed day care facility in other than a place of residence and excepting therefrom any metered parking spaces from use by permittees. (b) No vehicle shall be parked or stopped ad jacent to any curb in 2 - . Preferential Parking Zone C during the hours of 6:00 p.m. to 2:00 a.m. without a permit issued and displayed in accordance w~th this Chapter. Any vehicle parked or stopped without a permit may be removed from the street by any police officer. {c) The annual fee for each permit lssued for Preferential Parking Zone C shall be $15.00 per permit or such other fee as may be established from time to tlme by resolution of the Clty Council. SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto lnconsistent with the provisions of this ordlnance, to the extent of such lnconslstencles and no further, are hereby repealed or modlfied to that extent necessary to affect the provisions of this ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent )urisdlction, such decision shall not affect the valldlty of the remalnlng portlons of the ordlnance. The Clty Council hereby declares that lt would have passed this ordinance and each and every sectlon, subsection, sentence, clause or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. 3 , e e SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this ord1nance. Th1s City Clerk shall cause the same to be published once 1n the off1cial newspaper w1thin 15 days after its adoption. The ordinance shall became effective after 30 days from its adoption.
