AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA ESTABLISHING
SUPPLEMENTAL PROCEDURES FOR INSTITUTING
RESIDENTIAL STREET LIGHTING IMPROVEMENTS
WHEREAS, there eXlsts in many multifamily neighborhoods in
the Clty of Santa Monica the need for street lightlng: and
WHEREAS, tenants in these neighborhoods desire the City
Councl1 of the City of Santa Monlca to provide street lighting in
these neighborhoods: and
WHEREAS, the City of Santa Monica is unab Ie to pray ide
street lighting without utilizing the procedures of the
Improvement Act of 1911 which finances the costs of street
lightlng lmpravement through assessments against real property
benefitted by the assessments,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1.
Section 7160 is added to the Santa Monica
Municipal Code to read as follows:
Section 7160.
Institution of
Residential Street Lighting Improve- ment
Proceedings by Tenant Petitlon. Whenever
the occupants of sixty percent af the

residential un1ts in any area petition
the City Council to institute proceedings
for residential street lighting
improvement, the City Council shall
institute proceedinqs under the
Improvement Act of 1911 to provide
residential street lightlng to such area.
The petltlon shall be on the form
approved by the Director of General
SerVlces.
SECTION 2. Any provlsion of the Santa Monica Municipal
Code or appendices thereto lncons1stent with the provisions of
this ordinance, to the extent of such incons i stenc i es and no
further, is hereby repealed or modifled to that extent necessary
to affect the provislons of this ordinance.
SECTION 3. I f any section, subsectlon, sentence, clause,
or phrase of thlS ordlnance is for any reason held to be invalid
or unconstltutlonal by a declsion of any court of competent
]urisdictlon, such decision shall not affect the validity of the
remaining portions of the ordinance. The City Council hereby
declares that it would have passed this ordinance and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether
any portlon of the ordinance would be subsequently dec lared
invalid or unconstitutional.

SECTION 4.
The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance.
The City Clerk shall
cause the same to be published once in the official newspaper
within fifteen (15) days after its adoption. The ordinance shall
become effective thirty (30) days from lts adoption.
