AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
AMENDING SECTION 4107 OF THE
SANTA MONICA MUNICIPAL CODE
RELATING TO
HORSES, MULES, BURROWS AND JACKS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Sectlon 4107 of the Santa Monica Municlpal
Code is amended to read as follows:
Section 4107. Horses, Mules, Burros,
or Jacks. No person shall keep more than two
horses, mules, burros, or jacks in an open
corral within the City of Santa Monica unless
such person shall have obtained a permit from
the Humane Officer so to do.
In no event
shall any person keep any horse, mule, burro,
or jack within 300 feet of any "R" or "C"
district as defJ.ned in Article IX of this
Code, except that any person operating a
business
in
any "e" district whl.ch lS
prJ.ncipally devoted to the sale or display of
animals may sell or display in such business

any mJ.nature horse, minature mule, rninature
burro, or minature Jack.
SECTION 2.
Any provision of the Santa Monica Municipal
Code or appendices thereto 1nconsistent with the provisions of
this ordinance, to the extent of such J.nconsistenCJ.es and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of thJ.s ordinance.
SECTION 3.
If any section, subsection, sentence, clause,
or phrase of this ordl.nance is for any reason held to be invalld
or unconstitutional by a decision of any court of any competent
Jurl.sdiction,
such dec1sion shall not affect the valJ.dJ.ty of the
remaJ.ning portions of the ordinance. The City Council hereby
declares that 1t would have passed this ordinance and each and
every
section,
subsection, sentence,
clause or phrase not
declared invalid or unconstltutional without regard to whether
any port10n of the ordinance would be subsequently declared
inva1J.d or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. This City Clerk shall
cause the same to be publl.shed once in the official newspaper
within 15 days after its adoption.
The ordinance shall become
effective after 30 days from l.ts adoption.
