AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
APPROVING DEVELOPMENT AGREEMENT
BETWEEN MARTIN CADILLAC CO., INC.,
AND THE CITY OF SANTA MONICA
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1: The Development Agreement attached hereto and
incorporated by reference between Martin Cadillac Co. Inc., a
CalifornIa corporatIon, and the CIty of Santa Monica, a munIcIpal
corporatIon, IS hereby approved.
SECTION 2:
Each and every term and condition of the
Development Agreement approved In SectIon 1 of thIS ordinance
shall be and IS made a part of the Santa MonIca MunICIpal Code
and any append1ces thereto.
The CIty CounCIl of the CIty of
Santa MonIca fInds that the Development Agreement IS conSistent
WIth the General Plan and any applIcable specIfIC plans and that
the publIC neceSSIty, public convenience, and general welfare
reqUIre that any proviSIon of the Santa MonIca MuniCipal Code or
appendIces thereto 1ncons1stent With the prOVISIons of this
Development Agreement, to the extent of such inconsistencIes and
no further,

repealed or modIfIed to that extent necessary

to make fully effective the prOVISIons of thIS Development
Agreement.

SECTION 3. Any provIsIon of the Santa MonIca MunIcipal Code
or appendIces thereto inconslstent with the provISIons of this
ordInance, to the extent of such InconsIstencIes and no further,
is hereby repealed or modlfled to that extent necessary to glve
full force and effect to the provlslons of th1S ordlnance.
SECTION 4. If any section, subsection, sentence, clause, or
phrase of thls ordinance is for any reason held to be InvalId or
unconstItutlonal by a deciSIon of any court of competent
jurlsdlctlon, such decls10n shall not render lDvalld the
remaIning portIons of thls ordInance. The CIty Council hereby
declares that It would have passed thlS ordlnance and each and
every section, subsectIon, sentence, clause, or phrase no t
decl ared Invalld or uncons ti tu tIonal Wl thout regard to whether
any portIon of the ord1nance would be subsequently declared
Inval1d or unconstItutional.
SECTION 5. The Mayor shall SIgn and the CIty Clerk shall
attest to the passage of thIS ordInance. The CIty Clerk shall
cause the same to be publIshed once In the offlclal newspaper
wIthIn 15 days after ItS adoptIon. The ord1nance shall become
effect1ve 30 days from Its adopt1on.
