AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
AMENDING CHAPTER 6 OF ARTICLE IV
OF THE SANTA MONICA MUNICIPAL CODE,
RELATING TO IMPLEMENTATION OF THE
RENT CONTROL LAW
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 4606 of the Santa Monica Municipal Code
is amended to read as follows:
SECTION 4606.
BOARD PART OF
GOVERNMENT. The Rent Control Board shall
be an integral part of the government of
this C~ ty.
The Rent Control Admini-
strator and Administration Staff shall
administer and supervise the flnancial
and personnel affairs of the Board
consistent with the City Charter and this
Chapter.
The Rent Control Board shall
comply with the provisions of the Ci ty
Charter providing for a centralized
purchasing system and competitive
bidding.

SECTION 2. Section 4607 of the Santa Monica Municipal Code
is amended to read as follows:
SECTION 4607. STATUS OF BOARD
EMPLOYEES. Except for the elected or
appointed members of the Rent Control
Board, all employees of the Board are
Wlthin the classified service of the
Ci ty. All employees of the Board shall
be hired in accordance with the Ci ty
Charter and this Code.
The Board sha 11
classify employee positions, establish
employee salaries and benefits, and
evaluate employee performance of its
employees. The termination, suspension,
and demotion of Rent Control Board
employees shall be effectuated in
accordance with the City Charter and this
Code. Consistent w1th its power to hire
and pay employees, the Rent Control Board
may enter into a memorandum of under-
standing with its employees consistent
W1 th provisions of the City Charter and
this Code.
SECTION 3. Section 4609 of the Santa Monica Municipal Code
is amended to read as follows:
SECTION 4609. INTEGRITY AND
AUTONOMY OF ELECTED BOARD. Nothing in

this Chapter shall be construed as
authority to abridge the power of the
Rent Control Board to determine its own
financial, personnel, and budgetary
policies consistent with the City Charter
and this Code. The City council shall
not unreasonably withhold funds or
approvals necessary to ensure that the
policies and purposes of the Rent Control
Law and this Code are carried out fairly
and efficiently and that the law be
upheld and adequately enforced.
SECTION 4. Section 4611 of the Santa Monica Municipal Code
is amended to read as follows:
SECTION 4611.
BOARD LEGAL WORK.
Legal Staff hired by the Rent Control
Board shall represent and advise the Rent
Control Board and its staff in any or all
actions and proceedings in which the
Board or its staff, in or by reason of
their official capacity, are concerned or
are a party.
SECTION 5. Any provision of the Santa Monica Municipal
Code or appendices thereto inconsistent with the provisions of
this ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this ordinance.

SECTION 6.
If any section, subsection, sentence, clause,
or phrase of th1S ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of any competent
jurisdictlon, such decision shall not affect the validity of the
remaining portions of the ordinance.
The City Council hereby
declares that it would have passed this ordinance and each and
every section, subsection, sentence, clause or phrase not
declared invalid or unconstitutional without regard to whether
any portion of the ordinance would be subsequently declared
invalid or unconstitutional.
SECTION 7.
The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance.
This City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoption.
The ordinance shall become
effective after 30 days from its adoption.
