AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA ADDING
SECTION 2203 TO THE SANTA MONICA
MUNICIPAL CODE ESTABLISHING A
MUNICIPAL SOIAR UTILITY
WHEREAS, the application of solar energy systems and the
efficlent
use
of
cony en tional
energy sources in homes,
businesses, and industries in the City will reduce utility bills
for residents, stimulate the local economy, create private sector
jobs, reduce air pollution, and mitigate the potential adverse
effects of future fuel shortages; and
WHEREAS, the City desires to promote the use of solar
energy systems and energy efficiency measures; and
WHEREAS, barriers to the increased use of solar energy
systems include high initial cost and consumer uncertainty; and
WHEREAS, a solar energy system leasing program utilizing
private lessors and consumer protection procedures can reduce
those barriers; and
WHEREAS, the City desires to facilite the leasing of solar
energy systems and to assist in the prevention of fraudulent
leasehold-marketing practices; and
WHEREAS, the Revenue and Taxation Code provides that tax
credits are available for solar energy systems leased from a

municipal solar utility or from a lessor granted a permit from a
municipal solar utility provided the municipal solar utility was
created by ordinance by January 1, 1983: and
WHEREAS, the City desires to establish a Municipal Solar
Utility to effectuate the purposes of this ordinance,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 2203 1S added to the Santa Monica
Municipal Code to read as follows:
There is hereby created as a
division of the General Services
Department a Municipal Solar Utility.
The Municipal Solar Utility shall develop
and implement a solar leasing program and
other programs which shall be adopted and
from time to time amended by resolution
of the City Council.
SECTION 2. Any provision of the Santa Monlca MUnicipal
Code or appendices thereto inconsistent with the provisions of
this ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this ordinance.
SECTION 3. If any section, subsection, sentence, clause,
or phrase of this ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the
remaining port10ns of the ordinance. The City Council hereby

declares that it would have passed this ordinance and each and
every
section, subsection, sentence, clause or phrase not
declared invalid or unconstitutional without regard to Whether
any portion of the ordinance would be subsequently declared
invalid or unconstitutional. SECTION 4.
The Mayor shall sign
and the City Clerk shall attest to the passage of this ordinance.
This Clty Clerk shall cause the same to be published once in the
official newspaper within 15 days after its adoption. The
ordinance shall become effective after 30 days from its adoption.
