AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA ADDING
SECTION 4204b TO THE SANTA MONICA
MUNICIPAL CODE PROHIBITING THE
POSSESSION OR USE OF GLASS CONTAINERS
IN CERTAIN AREAS OF THE CITY
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Section 4204b 1S added to the Santa Monlca
Municipal Code to read as follows:
SectIon 4204b. Glass Containers on
Beach.
No person shall possess or use
any glass conta1ner upon any public
beach, any public beach parking lot, the
promenade, the beach bikepath, any picnic
area or playground area on or adJacent to
the beach, and on any publl.c area of the
Municipal P1er.
Any person v10lating
thl.S sectl.on shall be guilty of an
infraction.
Any person convicted of an
lnfract10n under this sectlon shall be
punl.shable by a flne of not more than
$25.00.

SECTION 2.
Any provision of the Santa MonIca MunICIpal
Code or appendlces thereto inconsistent with the provis1ons of
this ordlnance, to the extent of such 1nconsIstenc1es and no
further, are hereby repealed or modifIed to that extent necessary
to affect the prOVl.S10nS of this ordlnance.
SECTION 3. If any sectIon, subsectIon, sentence, clause,
or phrase of thIS ord1nance 1S for any reason held to be 1nvalld
or unconstItutIonal by a decision of any court of any competent
JurisdIction, such deC1S1on shall not affect the val1dIty of the
remaIning portIons of the ordInance. The C1ty Council hereby
declares that it would have passed this ordInance and each and
every
section, subsectIon, sentence, clause or phrase not
declared l.nvalld or unconstItut1onal w1thout regard to whether
any port1on of the ordInance would be subsequently declared
1nval1d or unconst1tutlonal.
SECTION 4. The Mayor shall sign and the CIty Clerk shall
attest to the passage of th1S ordInance. This C1ty Clerk shall
cause the same to be published once in the off1c1al newspaper
w1thIn 15 days after its adoptIon.
The ordInance shall become
effectIve after 30 days from l.ts adoptIon.
