AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SECTIONS
3395 AND 3395A OF THE SANTA MONICA
MUNICIPAL CODE AND REPEALING SECTION 3395B
OF THE SANTA MONICA MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 3395 of the Santa Monica Municipal
Code is amended to read as follows:
Sect10n 3395. Notwithstand1ng
any other provision of this Code to
the contrary, violation of Sections
3202, 3203, 3204, 3205, 3206, 3208C,
3209, 3210, 3324, 3325, 3326, 3329,
3330, 3335, 3336, 3337, 3338, 3339,
3340, 3341, 3342, 3343, 3345, 3346,
3348, 3349, 3350A, 3350.1, 3353,
3354, 3355, 3356, 3357, 3366A, 3370,
3371, 3372, 3374A, 3374Al, 3374B,
3374C, 3375A, 3375B, 3375Bl, 3376,
3377, 3378 or 3379 of this Code shall
be punishable by the following fines:

1. If court appearance is made
or bail posted within the time set
forth in the notice of citation of
violat10n, not less than twenty-five
dollars ($ 25.00) shall be assessed.
2. If no appearance is made
nor required bail posted as set forth
in subsection 1 above, after a
warrant of arrest is issued in the
manner required by law, not less than
fifty dollars ($ 50.00) shall be
assessed.
SECTION 2. Sect10n 3395A of the Santa Monica Municipal
Code is amended to read as follows:
section 3395A. Notwithstandlng
any other provis10n of th1s code to
the contrary, violation of Sections
3201, 3207, 3212, 3332, 3333, 3350,
3351, 3352, 3352B, 3364, 3365, 3366,
3367, 3368, 3373, 3374, 3373, 3380a,
3380b, 3394A, 3394B, or 3394C of this
Code shall be punishable by the
follow~ng fines:
1. If court appearance is made
or bail posted wlthin the time set
forth in the notice of citation of
violation, not less than ten dollars

($ 10.00) shall be assessed.
2. If no appearance is made
nor required bail posted as set forth
1n subsection 1 above, after a war-
rant of arrest is issued in the man-
ner required by law, not less than
twenty-five dollars ($ 25.00) shall
be assessed.
SECTION 3. Section 3395B of the Santa Monica Municipal
Code is repealed.
SECTION 4. Any provision of the Santa Monica Municipal
Code or append1ces thereto inconsistent with the prov1sions
of th1s ordinance, to the extent of such 1nconsistencies and
no further, 1S hereby repealed or modified to that extent
necessary to affect the prov1sions of this ordinance.
SECTION 5. If any section, subsection, sentence,
clause, or phrase of th1s ord1nance is for any reason held to
be 1nvalid or unconst1tutional by a decision of any court of
competent Jurisdiction, such decision shall not affect the
validity of the remaining portions of the ordinance. The
City Council hereby declares that 1t would have passed this
ordinance and each and every section, subsection, sentence,
clause, or phrase not declared invalid or unconstitutional
without regard to whether any portion of the ordinance would
be subsequently declared invalid or unconstitutional.
SECTION 6. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City

Clerk shall cause the same to be published once in the
off1cial newspaper within 15 days after its adoption. The
ordinance shall become effect1ve 30 days from its adoption.
