AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING
SECTIONS 6204H, 6204H2 and 6236 OF THE
SANTA MONICA MUNICIPAL CODE TO PROVIDE
FOR THE LICENSING OF HYPNOTISTS
AS PROFESSIONALS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS
FOLLOWS:
SECTION 1. Section 6204H of the Santa Monica Municipal Code
is hereby amended to read as follows:

Excepting that certa1n area of the City lY1ng
west of the public way commonly known as PThe
Promenade" along the Ocean Front and between
the south boundary of the C1ty and Kinney
Street, or premises located upon the Santa
Mon1ca
Amusement
P1er, which areas are
generally known as the Amusement Zone, and
wherein, if duly licensed under the provision
of this Code, a person may engage in fortune
telling for amusement purposes, no person
shall carryon, practice, or profess to
practice the business or art of astrology,

phrenology, lIfe reading, fortune-telling,
cartomancy, clairvoyance, clairaudience,
crystal gazing, medIumsh1p, oriental
mysteries, spirit photography, spiritwriting,
spirit voices, spirit materialization,
ethereal~zation, numerology, physiognomy,
psychometry, seersh1p, prophecy, augury,
div1natIon, magic or necromancy, or other
similar art or busines, and demand or recieve
airectly or indirectly, a fee or reward, or
accept any donation for the exercise or
exhibition of this art therein, or give an
exhib1tion of this art therein, or give an
exhibitIon thereof at any place where an
admIssion fee, donatIon, or reward lS charged
or received, directly or indirectly, or teach
or give instruction In any such art or
business and demand or receive, d~rectly or
IndIrectly, a fee or reward, or accept any
donation for such teaching or 1nstruction.
SECTION 2. Section 6204H2 of the Santa Monica Municipal
COUrt is hereby amended to read as follows:
SECTION 6204H2. Fees. Astrology,
palmistry, phrenology, l~fe-reading,
fortune-telling, cartomancy, clairvoyance,
clalraudience, crystal-gaZIng, medlumship,
prophecy,
augury,
divination,
magIc,

necromancy, or other similar art or bus1ness,
and for which there is demanded or received a
fee for the exercise or exhibition of his art
thereIn, or IndIrectly either as a gift,
donation or otherwise, or gives an exhibition
thereof at any place where an adm1ssion fee
is charged, $100.00 per annum.
SECTION 3. Section 6236 of the Santa Monica Municipal Code
is hereby amended to read as follows:
SECTION 6236. professional. Any
person, group, association, partnership, firm
or corporation engaged in a profession,
vocation or calling, listed hereinafter Or
not specifically provided for in any other
section of this code, the business tax shall
be $20.00 for gross receipts of less than
$6,000.00, and in additIon thereto, $ .65 per
each $1,000.00 or fraction thereof of gross
receIpts in excess of $6,000.00. In no event
shall any license fee, required to be paid
pursuant to this sect1on, be in excess of
$2,000.00.

profession, the City Clerk may require,
before issuing a 11cense pursuant to this
section, the applicant to exhibit an
unexp1red and unrevoked l1cense entitling
said applicant to practice in the State of
California.
SECTION 4. Any provision of the

further, are hereby repealed or modified to that extent necessary
to affect the provIsions of thIS ordinance.
SECTION 5. If any section, subsection, sentence, clause,
or phrase of this ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of any competent
JurisdIctIon, such decision shall not affect the validity of the
remd1ning portions of the ord1nance. The City CouncIl hereby
declares that it would have passed thIS ordinance and each and
every
section, subsection, sentence, clause or phrase not
declared invalId or unconstitutional without regard to whether
any portion of the ordInance would be subsequently declared
invalid or
SECTION 6. The Mayor shall sign and the City Clerk shall
attest to the passage of thIS ordinance. This City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoptIon.
The ordinance shall become
effective after 30 days from its adoptIon.
