AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA AMENDING
SECTION 10103 OF THE SANTA MONICA MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 10103 of the Santa Monica Munic1pal
Code is amended to read as follows:
Section 10103. Indemnity. The
pr1vileges of using the airport and
1ts facilities shall be conditioned
on the assumption of full responsi-
bility and risk by the user thereof,
and the user shall release, hold
harmless and indemnify the City,
members of the City Counc11, Boards
and Comm1ssions, and off1cers and
employees of the City from any
11ability or loss result1ng from
such use. All aircraft owners and
operators shall be covered at their

expense by public l~ability insurance
in such amounts and terms as estab-
lished and from time to time amended
or revised by Resolution of the
C~ty Council.
SECTION 2. Any provision of the Santa Monica Mun1cipal
Code or appendices thereto inconsistent w~th the provisions
of this ordinance, to the extent of such inconsistencies and
no further, is hereby repealed or modified to that extent
necessary to affect the provisions of this ord1nance.
SECTION 3. If any sect10n, subsection, sentence,
clause, or phrase of this ordinance is for any reason held to
be invalid or unconstitutional by a dec1sion of any court of
competent Jurisdiction, such decision shall not affect the
validity of the remaining portions of the ordinance. The
City Council hereby declares that it would have passed this
ordinance and each and every section, subsection, sentence,
clause, or phrase not declared invalid or unconstitutional
without regard to whether any portion of the ordinance would
be subsequently declared invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The C1ty
Clerk shall cause the same to be pub11shed once 1n the

official newspaper within 15 days after its adoption. The
ordinance shall become effective 30 days from its adoption.
