AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA AMENDING
SECTION 4204a OF THE SANTA MONICA
MUNICIPAL CODE AND ADDING SECTION
3606a TO THE SANTA MONICA MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS
FOLLOWS:
SECTION l.
Section 4204a of the Santa Monica Municipal
Code is amended to read as follows:
Section
4204a.
Drinking
Upon
Public Property. No person shall drink
any malt, splritous or vinous liquor
containing more than one-half of one
percent alcohol by volume upon any publlC
street, alleyway, sidewalk, or parkway,
or
in
any
public bUllding, public
lavatory, auto park, public park, beach,
or lobby or entrance-way to any building
within
the City; provided that this
section
shall
not
apply to pUblic
property
occupied by private persons
under lease, permit, or license from the
City when such lease, permit or license
permits the sale and consumption of such
beverages.
Any person violating this

section shall be guilty of an infraction.
Any person convicted of an infract10n
under this section shall be punishable by
a fine of not more than $100.00. Unless
the arresting officer has reason to
believe that the person has failed to
give his or her proper identity, any
person arrested for vIolation of this
sect10n shall be released in accordance
with Section 3606 hereof upon his or her
written promise to appear.
SECTION 2. Section 3606a is added to the Santa Monica
Municipal Code to read as follows:
Section 3606a. Failure to Pay
Fine. Any person willfully failing to
pay any lawfully imposed fine for a
violation of any prov1sion of the Santa
MonIca City Charter, the Santa Monica
Municipal Code, or ordinance of the City
of Santa Monica within the time
authorized by the court and without
lawful excuse having been presented to
the court on or before the date the f1ne
is due is gU1lty of a misdemeanor
regardless of the full payment of the
fIne after such time.

SECTION 3.
Any provision of the Santa Monica Municipal
Code or appendices thereto inconsistent herewith, to the extent
of such 1nconsistencies and no further, are hereby repealed or
modified to that extent necessary to effect the provisions of
this ordinance.
SECTION 4. This ordinance, and each part hereof, shall be
fully severable. If any part of this ordInance is declared to be
invalId for any reason, such declaration of invalidity shall not
affect the remaining parts of this ordinance.
SECTION 5. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall
cause the same to be published once in the official newspaper
within fifteen (15) days after its adoption. The ordinance shall
become effective after thirty (30) days from ltS adoption.
