O1209 .- e e CA:RMM:SSS Council Meeting 7-14-8l Santa Monica, California ORDINANCE NO. 1209 (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SECTION 2107B OF THE SANTA MONICA MUNICIPAL CODE TO LIMIT OUTSIDE EMPLOYMENT OF CITY MANAGEMENT OFFICIALS THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS FOLLOWS: SECTION 1. Section 21078 of the Santa Monica Municipal Code is amended to read as follows: Section 21078. Outs1de Activities. Full time employees in the classified service of the city may engage in part-time or occasional outside work, occupation, or business activity for remuneration or profit, herein referred to as Outside Activity, outs~de of their regular working hours if such Outside Activ1ty will not interfere with the effIcient and effective performance of their dut1es with the city and is approved 1n advance by the Personnel Board on written recommendation of the appointing authority. The appointing authority shall not recommend, nor shall the Personnel Board e e approve, any proposed Outside Activity when such activity would create a conflict of responsibility or duty between the employee's city work responsibility and the proposed Outside Activity. Any Outside Activity which would, by its nature, tend to reduce the ability of the employee to exercise completely independent and unfettered judgment with respect to effectively discharging city work responsibility is proh ibi ted. Notwithstanding any other provision of law, any Outs~de Activity in any way related to the professIonal field or official function of the City Manager, C~ty Attorney, and C~ty Clerk is prohibited except upon specific appl~cation and approval by the City Council, and any Outside Activity In any way related to the professional field or offIcial function of any Department Head or Divis~on Manager of the City is prohIbited except upon specific application and approval by the City Manager. The City Manager shall determine which positions are "Division 2 e e Managers. II Educational activities at accredited ~nstitutions are exempted from this prohibItion to the extent such activities do not conflict with the offiCial functions of such employees. SECTION 2. Any provlsion of the Santa MonIca Municipal Code or appendices thereto inconsistent herewith, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to effect the provisions of this ordinance. SECTION 3. This ordinance, and each part hereof, shall be fully severable. If any part of this ordinance is declared to be lnvalid for any reason, such declaration of invalidity shall not affect the remaining parts of this ordinance. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this ordlnance. The City Clerk shall cause the same to be published once in the official newspaper within fifteen (l5) days after its adoption.
