present helght 11.r.lt to a deslgnated two storles and 30', wh~ch
would tend to discourage large projects~ and
WHEREAS, reductlon of the heigllt 1uut to two stories
and 3D' wlll not iwpalr the ~ntent of the ne~ghborhood co~~ercial
district, but may alscourage unnecessary rel.loval and loss of
needed retail and serVlce ~ses; and
WHEREAS, the ~roposed a~enlli~ent lS ~n the public
lnterest, convenlence, necessJ..ty, general welfare, in accordance
w1th good zonlng pract1ce and should be adopted; and

WHEREAS, a public hearing was held before the Planning
Commission on August 4, 198m, and the Planning Commission con-
s~dered and recommended the amendment to the City Counc~l; and
WHEREAS, the City Council, after a public hearing
concurs with the recommendations of the Planning Commission,
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN:
SECTION 1. Section 9ll5Bl of the Santa Monica Municipal
Code ~s hereby amended and as amended shall read as follows:
1. Build~n~ Height:
Any building or structure erected in thlS nistrict
shall not exceed two (2) storles and thir~YH (30) feet
1n height; provided that an additional ten (10) feet
may be allowed for roof top mechan~ca1 equipment only.
SECTION 2. Any provision of the Santa Monica Munic~pal
Code or appendices thereto incons~stent therew~th, to the extent
of such incons~stencies and no further, are hereby repealed or
modified to that extent necessary to effect the provisions of
this ord~nance.
SECTION 3. If any section, sUbsection, sentence, clause,
or phrase of this ordinance is for any reason held to be inval~d
or unconstitutlonal by a decision of any court of any competent
jurisdiction, such dec~sion shall not effect the validity of the
rema~n~ng portions of the ordinance. The City Council

hereby declares that it would have passed this ord~nance
and each and every section, subsection, sentence, clause, or
phrase not declared lnvalld or uncons~itutional wlthout regard
to whether any portion of the ord~nance would be subsequently
declared invalid or unconst1tutlonal.
SECTION 4. The Mayor shall sign ane the city Clerk
shall attest to the passage of thlS ordinance. The Clty Clerk

shall cause the saMe to be nublished once ~n the official
newspaper within 13 days after its auopt~oh. The orcinance
shall beCOL~ effective after 30 days from its adoption.
