AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING THE ORDINANCE
RELATING TO THE MORATORIUM ON CONSTRUCTION
AND DEMOLITION IN THE CENTRAL BUSINESS DISTRICT
WHEREAS, an ordinance was adopted
by the City Council
on October 28, 1980, declaring a moratorium on construction
and demolition in a portion of the Central BUS1ness District; and
WHEREAS, that ordinance will take effect after 30 days
from its adoption; and
WHEREAS, that ordinance provides two exemptions from the
morator1Uffi; and
W1iEREAS, it 1S desirable to provide for an exception
to allow a person to develop property during the moratorium if
the project is found harmonious with the purposes of the
moratorium and ln the best interests of the City; and
THE CITY COUNCIL OF THE CITY OF SA~TA ~QNICA O~PAINS AS
FOLLOWS:
SECTION 1.

torlum period may apply to the Planning Commission
for permlSSlon to do so. The application shall
set forth in detail the development activity pro-
posed to be done, together wlth dlagrams or plans
of any contemplated project, and shall state rea-
sons why the proposed development is in harmony
wlth the purposes of this ordinance and the preser-
vatlon of the communlty, and is otherwise in the
best interests of the City. The Planning Commission
shall have dlscretion to grant or deny any such
application, and may impose any condltions upon
lts permisslon that lt sees flt. An appeal from
a decislon of the Planning Commission may be made
to the Clty Councll, WhlCh may affirm, reverse,
or modify the decision of the Planning Commission.
The fl1ing of an appeal shall operate as a
stay of an approval for demo1itlon or construction.
The appeal must be considered by the City Council
at the next regularly scheduled meetlng following
proper notlce to all interested partles.
SECTION 2. Sectlon 3 of the moratorium ordlnance and sectlons
thereafter are renumbered accordlng1y.
SECTION 3. Any provislon of the Santa Monica ~~unicipal
Code or appendlces thereto lnconslstent therewlth, to the extent
of such inconslstencies and no further, ~re hereby repealed or
modifled to that extent necessary to effect the provisions of this
ordlnance. -2-

SECTION 4. If any section, subsectlon, sentence, clause,
or phrase of this ordlnance is for any reason held to be lnvalid
or unconstitutlonal by a decision of any court of any competent
Jurisdiction, such declsion shall not affect the validity of the
remaining portions of the ordinance. The City Council hereby
declares that it would have passed this ordlnance and each and
every section, subsection, sentence, clause or phrase not declared
invalid or unconstitutional without regard to whether any portion
of the ordinance would be subsequently declared lnvalid or
unconstitutional.
SECTION 5. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City
Clerk shall cause the same to be published once in the official
newspaper within fifteen (15) days after its adoption. The
ordinance shall become effective after thirty (30) days from
ltS adoption.
