AN ORDI~~NCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA AMENDING
SECTIONS 7112 AND 7113 OF THE SANTA
MONICA MUNICIPAL CODE TO ALLOW PUBLIC
WORKS PERMIT AND WORK FEES TO BE SET
BY RESOLUTION.
THE CITY COUNClt OF THE CITY OF SANTA MONICA DOES ORDAIN
AS FOLLOWS:
SECTION 1. Section 7112 of Chapter 1, Article VII of the
Santa Mon1ca Municipal Code is hereby amended and as amended shall
read as follows:
Section 7112 - Resurfacing Where Work 1S Done
by City Forces.
Where work is done by City Forces,
all excavations shall be refilled promptly
in the most workmanlike manner by the
permittee, and the surplus material removed
without delay. It shall be unlawful for
any person to fail, refuse, or neglect to
comply with any of these regulations, or with
any regulation of the Department of Public
Works governing the refilling of excavations.
The excavated or damaged area shall
be replaced by the Department of Public Works,

and the cost therefor shall be charged
to the person, firm, or corporat~on
maklng the excavation.
Permit fees and minlffiUffi work charges
for such work shall be establshed by Reso-
lution of City Council. The rnin~mum charge
for each type of work ~s based upon the
actual cost to do the smallest amount of
each type of work. Unit charges are to be
applled when the actual un~t charge exceeds
the stated m~nlmum.
SECTION 2. Sectlon 7113 of Chapter 1, Article VII of the
Santa Monica Munlclpal Code 1S hereby amended and as amended shall
read as follows:
Section 7113 - Resurfacing Where Work is Not
Done by City Forces.
Permlt fees and mlnimum charges
for inspectlon of resurfaclng work
shall be established by Resolutlon of
City Council.

ment of Public Works. All such work shall be
performed to the satisfaction of the S~perin-
tendent of Streets and under the supervision of
an inspector provided by hL~.
SECTION 3. Any provis~on of the Santa Monlca Municlpal Code
appendices thereto inconsistent therewith, to the extent of such
inconsistencies and no further, are hereby repealed or modified to
that extent necessary to affect the provLsions of this ordinance.

SECTION 4. If any section, subsection, sentence, clause,
or phrase of this ordina~ce is for any reason held to be invalid
or unconstitutlonal by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of the ordinance. The Clty Council ber~by
declares that it would have passed this ordinance and each and
every section, subsection, sentence, clause or phrase not invalid
or unconstitutlonal without regard to whether any portion of the
ordinance would be subsequently declared invalid or unconstitutional~
SECTION 5. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall
cause the same to be published once in the official newspaper
