WHEREAS, by Emergency Ordinance No. 1154 adopted April 14, 1980, the City Councll enacted a rnoratorlQ~ prohlblting the establishment of certaln def~ned adult uses 1n the City of Santa Monica for a perlod of SlX months, or unt11 such time as a permanent adult use orc1nance 1S adopted, wh1chever should f1rst occurj and WHEREAS, no permanent adult use ordinance has been enacted and Emergency Ord1nanee No. 1154 will expire by its term on October 15, 1980; and WHEREAS, the eondltlons spec1fled 1n the find1ngs of urgency and necessity 1n Emergency Ord1nanee No. 1154 as requ1rlng a morator1Uffi ~tlll obtaln and requlre that the moratorium be extended pend1ng enactment of a ~ermanent adult use ord1nancei and WHEREAS, additlonal tlme 1S requlred to study this problem and to prepare an adult use ord1nance w~lch will further the long term interests of eXlst~ng and fuLure residents of the . THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAn~S AS FOLLOWS: SECTION 1. The ~oratorium on the establishment of certaln deflned adult uses establlshed under the terms of Emergency Ordinance No. 1154 (CCS), is hereby further extended for a perlod of SlX months to and including Aprl1 14, 1981. SECTION 2. Any provlslon of the Santa Monlca Municlpal Code or appendlces thereto inconsistent therewlth, to the extent of such inconslstencles and no further, are hereby repealed or modlfled to that extent necessary to effect the provlsions 0:: thlS ordlnance. SECTION 3. If any section, subsection, sentence, clause or phrase of thlS ordlnance is for any reason held to be lnvalld or unconstltutlonal by a deClslon of any court of any competent Jurlsdlction, such declslon shall not affect the validity of the remalnlng portlons of the ordinance. The City Councll hereby declares Lhat it would have passed thlS ordinance and each and every sectlon, subsection, sentence, clause, or phrase not declared lnvalid or unconstltutlonal wlthout regard to whether any portion of the ordinance would be subsequently declared invalid or un- constltutlonal. SECTION 4. The Mayor shall slgn and the Clty Clerk shall attest to the passage of thlS ordlnance. The City Clerk shall cause the same to be publlshed once In the offlclal newspaper within 15 days after ltS adoptlon. The ordinance shall become effective after 30 days from ltS adoption.
