WHEREAS, by Emergency Ordinance No. 1154 adopted April 14, 1980, the City Council enacted a moratorium ?rohibltlng the estab11shnent of certain deflned adult uses in the Clty of Santa Monlca tor a period of six nonths, or untl1 such tlQe as a permanent adult use ordlna~ce 15 adopted, whlchever should first occur; and ~nI~REAS, no pe~nanent adult use ordinance has been enactec and Emergency Ordinance No. 1154 wlll expire by lts term on October 15, 19BO; and WHERK~S, the condltions speClfied In the flndings of urgency and neceSSl t~T J.ll Emergency Ordlnance No. 1154 as requirlng a moratorirnn still obtain and require that the ~oratorlum be extended pending enactnent of a pe~manent adult use ordinance; and WHEREAS, addltlonal ~ine lS requlred to study thls problem and to prepare an adult use ord~nance which wlll further t~e long term lnterests of eXlstlng and future resldents of the Clty of Santa Monlca ano be conslstent wlth the purposes and intent of the zon~ng regulatlons and General Plan of the Clty: ~. . e . -~ THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS FOLLOWS: SECTION 1. The moratorlum on the establ1shment of certaln defined adult uses establlshed under the terms of Emergency Ordinance No. 1154 (CCS), lS hereby further extended for a perlod of SlX months to and lncludlng April 14, 1981. SECTION 2. ThlS ord1nance 15 declared to be an emergency measure adopted pursuant to the provls1ons of Section 615 of the Santa ~onlca C1ty Charter and 1S necessary for preserving the publ1C peace, health, and safety, and the urgency for its adoptlon as set forth in the findings above. SECTION 3. Any provlslon of the Santa Monica Munlclpal Code or appendlces thereto lnconsistent herewith, to the extent of such 1nconsistenc1es and no further, are hereby suspended for the type of constructlon and development described herein during thlS moratorium. SECTION 4. If any provislon of thlS ordinance is held to be unconstitut1onal by any court of competent jurisdiction, it is the 1ntent of the Clty Council that such portion of such ordinance be severable from the rema1nder and that the remainder be glven full force and effect. SECTION 5. This ordlnance shall take effect and be in full force lrnmediately after the passage and adopt1on thereof and shall re~aln ln effect until April 14, 1981 at which tilne lt shall be of no further effect and shall be deemed repealed. -2- ... . e e . SECTION 6. The Mayor shall slgn and the City Clerk shall attest to the passage of thlS ordinance. The City Clerk shall cause the same to be pub11sned once in the official newspaper within 15 days after its adoption. The ord2nance shall become effective from and after ltS adopt2on.
