For the purpose of thlS section, height llmit is
the Llaximu~ roo= heig~t as defined by the City
Zonlng Ordlna~ce, excluding parapets, mechanical
houslngs and ot~er appurtenant roof-top structures
or penetratlons such as skyllghts, stairwells,
ventllatlon a~rla and other architectural amenlties
lntended to distlnguish the overall design, but
WhlCh do not -te~d to obscure the inte~ded height
lUll t s .
2. PerMitted Floor ~rea. Other sections of thlS Chapter
notwithstanding, the total adjusted floor area of any
building constructed in this dlstrict shall not
exceed three and three-tenths (3.3) times the
horlzontal area of the commercially zoned lot or

lots except that bUlldings In excess of the
limitation may be permitted by the lssuance of a
Condltlonal Use Permit under the procedures of
Section 9148 on the basis of an env~ronmental and
fiscal analysis satisfactorily demonstrating that
no significant adverse environmental or fiscal
impacts will occur as a result of the ~ncrea5ed
floor area. ~ulti-re5idential units devoted
strictly to apartment resiaen~ial uses shall be
computed at one-half (1/2) the actual total
adjusted floor area, and areas devotee to parking
structures below the first rloor level shall be
excluded.
~First floor level" meanS the floor
above the basement as de~lned in Section 9102 of_
the Munlcipal Code.
3. Yards:
a. Front Yard. A front yard shall he provlded and
maintained. Said yard shall have a minimun
depth as follows:
(1) Computat~on/D~ensior.s/Drlveway. Required
front yard space may be Frovided lTI any
configuratlon on any floor or floors
provided the f~rst floor area ~s not less
than 3% of the site area and not less than
eight feet wide. Only that port~on of a
drlveway forward of the foremost bUlldlng
line which 1S treated in an aesthetic manner
simllar or ide~tical to the remainder of
the front yard shall be included in tee
computation of fro~t yard area.
(2) CM-2 D1str1ct, east s1de of Ma1n Street,
a front yard equal to 3% of the total
site area shall be ?rov~ded for the f~rst
floor only.

{3} CM-2 Dlstrict, west side of Maln Street,
a front yard equivale~t to 3% of the to~al
site area multiplied by the number of floors
of the structure.
(4) CM-3 Distrlct, sa~e as CM-2, west slde.
(5} CM-4 District, same as CM-2, ~est side.
b. Side Yards. No slde yard shall be reQUlred
c. Rear Yard. A rear yard shall be provided a~d
maintained. Sald yard shall have a rnlnirnun
depth as follows:
(1) CM-2 District, east slde 0= ~a~n Street.
(a) No rear yard shall be requlred for o~e
story structures and for the firs~ ~locr
of a two story structure, provided t~at
any portion of the firs~ floor which is
within five feet of the rear property
line is not more than nine feet l~ ~elg~t
and is fully enclosed i.e., withou~ ~in-
daws, doors, or ventilation C?enln~S ?e~-
~itting visual access to adjoining res~-
dentia1 prc?erty. Any portion of ~he
first floor that either exceeds nir-e feet
in helght or is not fully enclosed shall
be at least five feet from t~e rear
property line. The minimum ~ear yard
requirement for the second story portion
of a two story structure shall be 25 feet.
(b) Use of Rear Yard. Co~erclal use of-tbe
rear yard is not pe~itted. ~on-co~srclal
uses and parking are pe~itted in the rear
yard to the rear property line on the g~ound
level.
(c) Use of Roof In Rear Yard. No nortion of the
first floor roof withln 15 feet of the rear
property llne may be used for any ?urpose
other than maintenance and repair. 'T~e next
10 feet may be privately us~j (not open to
the public) if enclosed with a solid six
foot barrier and window design tha~ prevehts
vlsual intrusion of adJoinlng residential
property.

(d) Exception. ?here shall be no rear
yard setbac~s re~Jired where exis~lng
parki~g i~?rove~ents and co~~on
o~~ership ex~e~d thro~sh to Seco~d
Street.
(2) CM-2 District, ~esc side of Main Stree~.
No rear yard s~all be required for one story
structures ~~d =0= the first 'floor of a two
story structure, ?rovided that a~y pcrtio~ of
the flrst floor s~ructure which is wi~~in flve
feet of the rear ?roperty line aoes ~o~ exceed
nine feet in heig~t. Any portion of ~he first
floor that eXcee~s nine feet in heigh~ shall
be at least five =eet from the rear ~rc~ertv line.

(3) CM-3 District. Rea= yard re~uire~ents i~

8. noise and Acoustic Control. Other sections of

a. Exterior wall and window construction must be

(1) Doors must be solid core or mineral
filled.
(2) Doors must be gasketed to provide a seal

(3) Main entrance nust contaln an "acoustic
lock" or other equlva1ent "sound trap."
c. The intent of thlS sect~on is to require an
establishment providing entertainment or loud
mUSlc to contain the resulting noise withln lts
walls to the greatest extent posslble.
9. Applicabllity, Effectlveness. Notwithstanding specl~lc
references conta~ned here~n, the provlslons of thlS
ordinance are not meant to apply to:
a. Current uses, regardless of changes 0=
ownership, unless the existing use is lntensl-
fled by a floor area .aedition of more than 15%
or by other substantlal intensification, such
