WHEREAS, the City Council of the City of Santa Monica, having once permitted the sale and discharge of safe and sane fireworks within the City during the period from June 28 to July 4, 1979, and having determined that the sale and d~scharge of fireworks within the City is inimical to the health and safety of the City; THE CITY COUNCIL OF THE CITY OF SAh~A MONICA ORDAINS AS FOLLOWS: SECTION 1. Chapter 7A of Article VI of the Santa Monica Munic~pal Code, established by Ordinance Number 1126 (CCS), is hereby repealed, and the sale and discharge of safe and sane fireworks within the C1ty is hereby expressly prohlblted. However, the Fire Chief may permit superv1sed public displays of fireworks as provided in Article 12 of the Uniform Fire Code. SECTION 2. Resolution Number 5301 (CCS), establish~ng a procedure for the processing of permits to sell safe and sane fireworks within the City, is hereby rescinded and repealed. -. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent therewith, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the prov~sions of this ordinance. SECTION 4. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the valid1ty of the remaining portions of the ordinance. The Clty Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause or phrase not declared invalid or un- const~tutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 5. The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the offlcial newspaper within fifteen {IS) days after its adoption.
