AN ORDINANCE OF THE CITY COUNCIL OF THE C1TY
OF SANTA MONICA REPLACING CHAPTER 3A OF
ARTICLE III OF THE SANTA MONICA MUNICIPAL
CODE RELATING TO PARKING METERS.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN:
SECTION 1. Chapter 3A of Artlcle III of the Santa Monica Municipal
Code is hereby replaced and shall read 1n its entirety as follows:
Chapter 3A -- Parking Meters
SECTION 3387. All of the provisions of this Code concernlng
the parking of vehicles and the regulatlon of the parking of vehicles by
the use of parking meters are expressly enacted under the Constitution af
the State, Article Xl, Section 11, together with provisions of the Vehicle
Code of the State, as amended. The provisions set forth in the Vehicle
Code shall govern whenever this Code fails to set forth any speclfic
provisions.
SECTION 3388. Definitions.
For the purpose of this Chapter, certain words and phrases are
defined and certain provisions shall be construed as hereln set forth unless
it is apparent from the context that a different meaning is intended.
SECTION 3388A. Coin. The l</ord I'eoinll shall mean any
lawful coin or combination of coins of the United States of America as
designated by the legend on the parking meter.
SECTION 3388B. Hal; day. The word "hol i day" shall mean and
include the following days: The 1st day of January, the 12th day of

February, the 3rd Monday in February, the last Monday in May, the 4th
day of July, the 1st Monday in September, the
2nd Mopday in October, the 4th Monday in October, Thanksgiving Day, the
25th day of December and any other day designated by the City Council of
the City of Santa Monica as a day for public feast, thanksgivlng or
holiday.
SECTION 3388C. Operator. The vlord Iloperatorll shall mean and
include every indlvidual who shall operate a vehicle as the owner, or as
the agent, employee or permittee of the owner, or who is in actual
physical control of a vehlcle.
SECTION 33880. Parking Meter. The words "Parking Meter" shall
mean any mechanical device or meter erected for the regulation of parking
by authority of this Chapter.
SECTION 3389. Authority of the Parklng and Traffic Engineer.
SECTION 3389A. Deslgnation of Parking Spaces.
The Parklng and Traffic Engineer is authorized and empowered to
~ark off individual parking spaces in all Zones. Said parking spaces
snall be designated by lines painted or durably marked on the surface of
the street or on the curb.
SECTION 3389B. Installatlon of Parking Meters.
The Parking and Traffic Engineer is authorized and empowered to
install parklng meters upon the curb or sidewalk or other location provided
in1llediately adjacent to deslgnated parking spaces, as he deems
necessary. Each device shall display a signal showing legal parking upon
the deposit of appropriate coin and upon expiration of the lawful ti~e
limit shall indicate by a proper visible signal that the lawful parking

period has expired. No parking meter shall be capable of registering
permitted parking time in excess of the time limit established by the Parking
and Trafflc Engineer.
SECTION 3389C. Maintenance of Parking Meters.
The Parking and Trafflc Engineer shall be responsible for the
mainte~ance and operation of the parking meters.
SECTION 3389D. Reservation of Powers.
Nothing tn this chapter shall be construed as prohlbiting the
Parking and Traffic Engineer from provid1ng for pedestrian crosswalks,
bus stops, and taxicab stands and other matters of similar nature, including
the loading and unloading of trucks, vans, and other commercial vehicles,
nor as prohibiting said Parking and Traffic Engineer from establishing
maximum parking time limits pursuant to powers granted in Chapter 3 of
thlS article.
SECTION 3390. Operation of Parking Meters.
When any vehicle shall be parked in any metered parking space,
the operator immedlately shall deposit the required coin in the manner
prescribed on the parking meter unless the parking meter indicates an
unexpired portion remains of the period for which coins had been deposited
previously, or in a period of emergency determined by an officer of the
Fire or Police Department, or 1n compliance with the directions of a
pollce officer or traffic control sign Dr signal. In no event shall it
be lawful to park a vehicle in a deslgnated metered parking space in
excess of the maximum parking time limit set by the Parking and Traffic
Engineer.

SECTION 3391. Enforcement.
It shall be the duty of the Police Department to enforce the
provisions of this Chapter.
SECTION 3392. Funds Derived from Parking Meters.
SECTION 3392A. Collection.
The Director of Finance shall be authorized to make regular
collections of the money deposited in the parking meters and to deliver
the money to the City Treasurer who shall count and deposit the funds.
SECTION 3392B. Use of Funds.
The COlns deposited in parking meters shall be used to defray
the expense of proper regulation of traffic upon the public streets of
the City; to provide for the cost of supervision, regulation and control of
the parking of vehicles in parking meter zones; and to cover the cost of
purchase, supervlsion, protection, inspection, installation, operation,
maintenance, control and use of parking meters and may be used for such
other purposes as are proper.
SECTION 3393. Parking Meter Zones.
The City shall be divided into the following parking meter zones
and each zo~e shall be subject to the rules and regulations established for
that zone, as set forth below:
SECTION 3393A. Parking Meter Zone "AII.
(1) The following named and described streets or portions
of streets within the City shall constitute Zone "All, namely:
(a) All of Ocean Avenue and all streets southwesterly thereof,
1ncluding the municipal pier, and excluding the area bounded by Pica Boulevard

to the South City limits~ Neilson Way to Ocean Avenue-Barnard Way,
inclusive;
(b) All streets lying within the area bounded by
Ocean Avenue, Lincoln Boulevard, California Avenue and Colorado Avenue,
including both sides of the boundary streets wtth the exception of Lincoln
Boulevard which shall not be lncluded in this Zone;
(c) All of Wilshire Boulevard to the easterly city
llmits from Lincoln Boulevard.
(2) Parking a vehicle in a designated space in Zone I\AIl
shall be lawful for 60 minutes upon the deposit of 10 cents in coin, and
for an additional 60 minutes for each 10 cents in coin deposited thereafter.
(3) Parking meters shall be operated in Zone nAil every day
between the hours of 9:00 a.m. and 6:00 p.m.
SECTION 3393B. Parking Meter Zone "B".
(1) The followlng named and described street~ or
portions of streets within the City sha 11 constitute Zone HBIl, namely=
(a) All streets or portions of streets in the area
bounded by Broadway, Twentieth Street, Virginia Avenue, and the Easterly
city limits, including both sides of the boundary streets.
(b) All of Colorado Avenue from Lincoln Boulevard to
Twentieth Street.
(2) Parking a vehicle in a designated space 1n lone IIBIl
shall be lawful for 60 minutes upon the deposit of 10 cents in COln, and
for an additional 60 minutes for each 10 cents in coin deposited thereafter.
(3) Parking meters may be operated in Zone IlBlI t\'/enty~four
hours per day or less, as posted by the Parking and TrafflC Englneer.

SECTION 3393C. Parki n9 Meter Zone "ell.
(1) All streets within the City not specifically described
in thlS section shall constitute Zone "CII.
(2) Parking a vehicle in a designated space in Zone IICU shall
be lawful for 60 minutes upon the deposit of 5 cents in coin and for an
addltional 60 minutes for each 5 cents in coin deposited thereafter.
(3) Parking meters shall be operated 1n Zone llell every day
between the hours of 9:00 a.m. and 6:00 p.m. except Sundays and holidays.
SECTION 3393D. Parking Meter Zone "0".
(1) The following named and described streets or
portions of streets of the City shall constitute Zone UO"; namely
(a) Pica Boulevard to the South City Limits, Neilson
Way to Ocean Avenue - Barnard Way inclusive.
(8) All of the westerly portion of Lincoln Boulevard
from Michigan Avenue to Pica Boulevard.
(2) Parking a vehicle in a deslgnated space in Zone "0"
shall be lawful for 60 minutes upon the deposit of 25 cents in coin, and for
an additional 60 minutes for each 25 cents in COln deposited thereafter.
(3) Parking ~1eters shall be operated in Zone "0" every day
between the hours of 9:QO a.m. and 6:00 p.~.
SECTION 3393E. Parklng Meter Zone liE II .
(1) The following named and described streets or
portions of streets lying within the City shall constitute Zone "['1; namely
all streets lying within the area bounded by Pica Boulevard, Third Street,
Southerly city limits and Neilson Way, exclusive of the boundary streets.

(2) Parklng a vehicle in a designated space in Zone liE"
shall be lawful for 60 m1nutes upon the deposit of 25 cents 1n coin~ and
for an additional 60 minutes for each 25 cents in coin deposited thereafter.
(3) Parking meters may be operated in Zone flE" 24 hours per
day or less~ as posted by the Parking and Traffic Engineer.
SECTION 3394. Violations
It shall be unlawful and a violation of the provisions of this
chapter for any person:
SECTION 3394A. To cause~ allow, permit or suffer any vehicle
registered in the name of, or operated by such person to be parked over-
time~ or beyond the period of legal parking time established for any
parking meter zone as hereln described~ or to deposit i~ any parking meter
any COln for the purpose of parking beyond the maximum legal parking time
for the particular parking meter zone,
SECTION 3394B. To permit any vehicle to remain or be placed in
any parking space adjacent to any parking meter whlle said meter is
displaying a signal indicating that the vehicle occupying such parking
space has already been parked beyond the period prescribed for such
parklng space.
SECTION 3394C. To park any vehicle across any 1ine or marking
of a parking ~eter space or in such position that the vehicle shall not be
entirely within the area designated by such lines or markings.
SECTION 3394D. To deface, injure, tamper with~ open or wilfully
break, destroy~or impare the usefulness of any parking meter installed
under the provisions of this chapter.
SECTION 3394E. To deposit or cause to be deposited in any
parking meter any slugs, device or metal substance, or other substitute for
lawful COlns.

SECTION 3395. Norwithstanding any other provision of this
Code to the contrary~ violation of Sections 3202, 3205~ 3206, 3208t 3326,
3326A, 33268, 3326C~ 3326D~ 3337, 3345, 3372, 3374A 3375A or 33758 of thlS
Code shall be punishable by the following fines:
1. If court appearance is made or bail posted within the time
set forth in the notice of citation of the violation, not less than Ten
Dollars ($10.00); and
2. If no appearance is made nor required bail posted as set
forth in Subsection 1 above, after notice is given pursuant to Section
41103 of the California Vehicle Code and a warrant of arrest is issued,
not less than Fifty Dollars ($SO.OO)shall be assessed.
SECTION 3395A. Notwithstandlng any other provision of this Code
to the contrary~ violation of Section 3210 of this Code shall be punishable
by the following fines:
1. If court appearance is made or bail posted within the
time set forth 1n the notice of citation of the violation, not less than
Twenty~fiye Dollars ($25.00); and
2. If no appearance is made nor required bail posted as set
forth in Subsection 1 above, after notice is given pursuant to
Section 41103 of the Ca1ifornla Vehicle Code and a warrant of arrest is
issued~ not less than One Hundred Dollars (SlOO.OO) shall be assessed.

SECTION 3395B. Notwithstanding any other provlsion of this Code
to the contrary, violation of Sections 3201,3364,3365,3366,3371,3373,
3374, 3375, 3394, 3394A, 33948, or 3394C of this Code shall be punishable
by the following fines:

1. If court appearance is made or bail posted within the time
set forth in the notice of citation of the violation~ not less
than Five Dollars ($5.00); and
2. If no appearance is made nor required bail posted as set
forth in Subsection 1 above, after notice is given pursuant to
Sectlon 41103 of the California Vehicle Code and a warrant of arrest is
issued~ not less than Twenty-five Dollars ($25.00) shall be assessed.
SECTION 2. Any provision of the Santa Monica Municipal Code or
appendices thereto inconsistent therewith, to the extent of such inconsis-
tencies and no further, are hereby repealed or modi fled to that extent
necessary to affect the provisions of this ordinance.
SECTION 3. If any sectlon, subsection, sentence. clause or phrase of
this ordinance is for any reason held to be invalid or unconstltutlonal
by a decision of any court of any competent jurisdictlon, such decision
shall not affect the validity of the remaining portions of the ordinance.
The City Council hereby declares that it would have passed this ordlnance
and each and every section, subsection, sentence. clause or phrase not
declared invalid or unconstitutional without regard to whether any portion
of the ordinance would be subsequently declared invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall attest
to the passage of this ordinance. The City Clerk shall cause the same
to be published once in the official newspaper withln fifteen (15) days
after its adoption. The ordinance shall become effective after thirty (30)
days from its adoption.
