O1147 , CA RL_~d Council M~ng 02/26/80 Santa Monlca, calif~nla4lt ORDINANCE NO. 11~7 (City CounCll Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA EXTENDING TEE EXISTING MORATORIUM ON THE APPROVAL AND PROCESSING OF CERTAIN CONDOMINIUM PROJECTS AND DECLARING THE PRESENCE OF AN EMERGENCY. WHEREAS, the City Councll, on May 8, 1979, adopted and approved Ordinance Number 1124 (CCS), creating a Morator~um on the approval or processing of certain condom~nlum proJects: and WHEREAS, on September ll, 1979, the City Council extended th1S moratOl.-iUnL until March 4, 1980; and ~~EREAS, the P1annlng Comm1ss1on has held a public hearlng on proposed amendments to the Santa Monica Municlpal Code related to condominlum converSlons; and WHEREAS, the Planning Commission has recommended that the moratorium be extended for a per~oct of n1nety (90) days to allow the Coromlsslon to submit recommendatlons and the Counc~l to act upon them: and WHEREAS the Clty Council hereby concurs and aff1rms the recommendatlons of the Planning Commlssion: THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS FOLLOWS: SECTION l. The moratorium on certain condominium or communlty apartment proJects ~nvo1ving the conversion or removal of controlled rental un~ts establ1shed under the terms of Ordlnance #l124 (CCS), lS hereby further extended for a perlod of ninety (90) days to and includlng June 4, 1980. -. it . SECTION 2. This ordinance is declared to be an emergency measure adopted pursuant to the prov~sions of Section 615 of the Santa Monica City Charter and 1S necessary for preserving the public peace, health and safety, and the urgency for lts adoption as set forth ~n the f~ndings above. SECTION 3. Any provision of the Santa Monica Municipal Code or appendlces thereto inconsistent herewith, to the extent of such lnconsistencies and no further, are hereby suspended for the type of construction and development described herein dur~ng th~s moratorium. SECTION 4. If any provision of thlS ordlnance is held to be unconstltut1onal by any court of competent jurisd~ction, it is the intent of the City Council that such portion of such ordinance be severable from the remainder and that the remainder be given full force and effect. SECTION 5. This ordinance shall take effect and be in full force immed~ately after the passage and adopt~on thereof and shall rema~n in effect untll September 4, 1979, at which time lt shall be of no further effect and shall be deemed repealed. SECTION 6. The Mayor shall sign and the C~ty Clerk shall attest to the passage of thlS ordlnance. The City Clerk shall cause the same to be publlshed once in the 6Sficial newspaper wlthin fifteen (15) days after its adoption. The ordinance shall become effective from and after ltS adopt16n.
