SANTA MONICA REPEALING SEC~ION 9620 OF THE SANTA MONICA M~NICIPAL CODE i:lh~REAS, the purpose of Article IX, Chapter 6 of the Santa Monica ~unicipal Code (Sections 9600-9620) is to protect the City's cultural, social, econonic, and political history~ HHE::tEAS, this purpose includes the promotion of the use of Landnarks and Historic districts for the education, pleasure, and welfare of the people of Santa Monica, WHEPEAS~ the Land~arks Commission of the City of Santa Monica has unanimously agreed that the dollar amount of current filing fees for Certificates of Appropriateness and for Landmark and Historic District Designations as set out in Section 9620 discourages historic preservation in Santa Monica~ THE CITY COUNCIL OF THE CITY OF SA~~A MONICA ORDAINS AS FOLLOWS: SECTION 1. Section 9620 of Article IX~ Sectio~ 6 of the Santa f'lonica Municipal Code ent i tled "FEEStl is hereby repealed. SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent therewith, to the extent of such inconsistencies and no further3 are hereby repealed or modified to that extent necessary to affect the provisions of this ordinance. .- .. SECTION 3. If any section, subsection, sentence, clause or phrase of this ordinance 1s for any reason held to be invalid or unconstitutional by a decision of any court of any cor.petent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordina~ce. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause or phrase not declared invalid or un- constitutional without regard to whether any portion of the ordinance would be subseQuently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the sane to be published once in the official newspaper within fifteen (15) days after its adoption.
