O1144 , CA RL~ss:val counce .t~ng Ol-08-80 Santa Monic~a~orn~a ORDINANCE 1144 (C1ty Councl1 Ser~es) AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING A MORATORIUM ON DEVELOPMENT IN CERTAIN PORTIONS OF THE OCEAN PARK AREA OF THE CITY. TEE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS FOLLOWS: SECTION 1. Declarat~on of Urgency. The Clty Counell finds and declares that: (a) The area of the Clty known as Ocean Park lS a communlty of unique character containing a diverslty of popu- 1ation and property, the preservat~on of which is ~n the best lnterests of the C1ty. (b) In recent months the Ocean Park area, and partlcularly the Maln Street commercial strip, has undergone substantial new development resulting 1n a prol~feration of restaurants, bars, and other buslness establlshments prlmarily catering to transients. (c) A substantial controversy has arlsen between many resldents of Ocean Park and the Maln Street business communlty, and involving others lnterested ln the welfare of the City over future development of the area; of partlcular con- cern are parking, vehlcular and pedestrlan traff1c, no~se, the maintenance of the character of the commun1ty, commerce, and quiet enjoyment of neighborhood services and amenitles. Counc etlng 01-08-80 ee (d) The long-ter.m welfare of the area, and thus of the City, requires careful deliberation and planninq includlng ample opportunity for communication by segments of the affected commun1ty and by the public generally. This cannot be accom- plished If development is allowed to proceed dur1ng the pendency of this planning process. (e) Necessary public hearings and other facets of the planning process are estimated to require six months to accomplish properly. (f) An immediate moratorium on development of the Maln Street area until after the Fourth Tuesday in June, 1980, is necessary to the orderly development and preservatlon of the affected area and the community, and lS thus necessary for the protection of the health, safety, and welfare of the City. SECTION 2. Moratorium. A mora~orium is hereby 1mposed on development on Ma1n Street and commercially zoned or used parcels on related side streets -- Marlne, Kinney, Pier, Ashland, Hill, Ocean Park Boule- vard, Norman, Hollister, Strand, Pacif1c, Bicknell, and Bay -- from Pico Boulevard to the South City limits, as shown on the map attached hereto. The moratorium shall expire on June 25, 1980. Unitl that date, no prohib1ted activity shall be conducted wlthin the moratorium zoner nor shall any City permit be issued for such activity. The terms of the ~oratorium are as follows: (a) The establishment of new bars, bar and grills, restaurants, discos, roller discos, Movie theaters, amusement -2- RLK:S..ii.:. Coun~ etlng 01-08-80 ee arcades, fast food take-out establ1shments within the zone 15 prohibited, as are new addltions of square footage, includ1nq patios, onto eX1sting restaurants, bars, bar and grills, or discos. (b) New windows that would allow buildir.g occupants to look into the back yards and homes located on abuttinq res1dent1al property, and are above the second floor, must be of translucent glass -- not frosted glass -- below a level five feet six inches above the floor. (c) New ?ark~ng lot entrances or ex1tS onto resideI1tial streets are prohibited. (d) New construct1on abutting residential property, in excess of thirty feet in height, including para~ets, lS prohibited. (e) Demol1tions are prohibited within the ~orator~um zone. SECTION 3. Exceptions to ~oratoriufl. A person who desires to develop or de~olish property within the moratorium zone during the morator1um perlod may apply to the Planning Commission for permission to do so. The application shall set forth in detail the development act~vlty proposed to be done, toqether with diagraMs or plans of any contemplated project, and shall state reasons why the proposed development is in harmony with the purposes of this ordinance and the preservation of the character of the community, and is otherwise ln the best interests of the City. The Planning Commission shall have discretion to grant or deny any such appllcat1on, and may impose any conditions upon its permission -3- RLI< : S.iii. =- Coun~"'etlng 01-08-80 ee that it sees fit. An appeal from a decislon of the Planning Co~mission ~ay be made to the C1ty Council, which may affirM, reverse, or modify the decision of the Planning Commission. SECTION 4. Vested Rights. A person shall have a vested right to cOMplete development within the morator1um zone durlng the moratorium period if, before January 8, 1980, that person had obtained the last governmental approval necessary to the complet1on of the proJect, lncluding but not limited to building permlts, Architectural Review Board approval, and Coastal CO~~lss10n approval, and, in addition, had expended substantial funds and incurred substantial liabilit1es in reliance on such final governmental approval. The Planning Comm~SSlon shall hear and determine claims of vested rights. An appeal from such decision shall be made to the City Council. SECTION 5. Declaratlon of Intent. The moratorium shall last only six months, during which time a Main Street Distr1ct Zone or other solutlon shall be created by City staff working w~th Main Street business and nelghborhood interests, and proposed to Councll. SECTION 6. Any provision of the Santa Monica Municlpal Code or appendices thereto inconslstent therewith, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the provisions of this ordinance. SECTION 7. If any section, subsection, sentence, clause, or phrase of this ordlnance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decislon shall not affect -4- RLK:~~ Counc~Meeting 01-08-80 ee the val1dity of the reMain~ng portions of the ord~nance. The Clty Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause or phrase not declared invalid or unconsti- tutional without regard to whether any portion of the ordinance would be subsequently declared lnvalid or un- constitutional. SECTION 8. Effective Date. As thlS ordinance is declared to be necessary for preserving the public peace, health, and safety of the City, 1t shall take effect immediately upon adoption pursuant to Sect10n 619(c) of the City Charter. -5- _e ee " ADOPTED AND APPROVED THIS 8th.
