O1141 CA rga~SS:dd Coun~Meeting 11-13-79 Santa Monica, ca~ic ORDINANCE NO. 1141 (City Council Se~ies) A\ ORDINA~C~ OF THE CI~Y COUNCIL OF TF~ CITY OF SANTA MONICA ADDI~G CHAPTER 8 TO ARTICLE rJ OF THE SANTA ~ONICA M~NICIPAL CODE RELATING TO CONSUMER PRO- TECTION AND IN PAPTICJLAR ITEM PRICING IN RE~AIL JROCERY STORES. THE CITY COUNCIL OF THE CITY OF SANTA HONICA DOES HEREBY O::1.DAIN: SECTION 1. Chapter 8 is hereby added to Article IV of ~he Santa Monica Municipal Code and shall read as 1'ollows: Section 4801. Readable prices on packaged consuner cor~odities; exemptions; definitions. (a) Every retail grocery store or grocery department within a general retail merchandise store shall cause to have a clearly readable price indicated on each packaged consumer commodity offered for sale. (b) The Drovisions of this section shall not apply to any of the following: 1. Any ~npackaged fresh food prod~ce, or to consumer commodities Which are under three cubic inches in size~ weigh less than three ounces~ and are priced under thirty cents ($0.30). 2. Any consune~ co~nodity offered as a sale item or as a special. " ~- 3. Any business which has as its only regular employees the owner thereof, or the parent, spouse, or child of such owner, or, in addition thereto, not more than two other regular employees. 4. Identical items within a multi-item package. ~ ,.., J. Iter,s sold through a vending machine. r o. Any consu~er-owned cooperative food store, owned and operated by its members, which sells food to its Menbers, and not to the general public. (c) For the purposes of this section: 1. "Consumer comnodity" includes: (a) Food, including all material whether solid, liquid, or Nixed, and whether si~ple or compound, which is used or intended for consunption by hu~an beings or domestic animals nornally kept as household pets, and all substances or ingredients added to any such ~aterial for any purpose. This definition shall not apply to individua~ packages of cigarettes or individual cigars. (b) Napkins, facial tissues, toilet tissues, ~oil vrrapping, plastic wrapping, paper to~eling, and disposable plates and cups. (c) Detergents, soaps and other cleaning agents. (d) Pharnaceuticals, including nonprescription drugs, bandages, ~emale hygiene products, and toiletries. 2. "Grocery department" neans an area wi t~in a general retail merchandise store which is engaged primarily in the retail sales of packaged food, rather than food -2- .~ JIll' prepared for ir~ediate consumption on or off the premises. 3. "Grocery store" means a store engaged priJ11arily in the retail sale of packaged food, rather than food prepared for cons~J11ption on the Dre~ises. 4. "Sale iteI'l or special" neans any consumer cOmBodity offered in good faith for a period of seven days or less, on sale at a price below the normal price that item is usually sold for in that store. Section 4802. Violations; civil fines; Injunctions. (a) The intentional violation of Section 4801 is punishable by a civil penalty of not less than Twenty-five Dollars (525.00) nor more than Five Hundred Dollars ($500.00). (b) Failure to have a clearly readable price indicated on 12 units of the sane iten of the same cOmModity shall constitute a presumption of intent to violate Section 4801. (c) Every additional 12 units of the same item that fail to have a price indicated on then shall constitute a presunption of intent to violate Section ilSOl. Cd) Each day that a violation continues shall also constitute a separate violation after notification thereof to the manager or assistant manager of the retail grocery store or the grocery department of the general retail nerchandise store and shall constitute a presuJ11ption of intent to violate Section 4801. (e) Notwithstanding any other provision of law, any person may bring an action to enjoin a violation of Section 4801. -3- 4t ~- (f) A~y person who violates Section 4801 shall be liable to any person injured for a~y losses and expenses thereby incurred, and for da~ages as provided in Section 4802(a) for intentional violations, in addition thereto. The remedies set forth in this section shall apply only to actions brought on behalf of a single plaintiff and shall not apply to ~ultiple plaintiffs or class actions. Section 4803. Unintentional error; no violation. Improper pricing on the shelf or on the item due to () unintentional error shall not constitute a violation of '-h" L,.,,;, ...!..S chapter. SECTION 2. Any Drovision of the Santa Monica Municipal Code or appendices thereto inconsistent ~herewlth, to trce extent of such inconsistencies a~d no further, are hereby repealed or modified to that extent necessary to affect the provisions of this ordinance. SECTION 3. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any conpetent j~risd~ction, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council hereby declares that it would have passed this ordinance and each and eve~y section, subsec~io~, sentence, clause or phrase not declared invalid or ~n- consti~utional without regard to whether any Dortion of ~he ordinance would be subsequently declared invalid or unconstitutional. -4- ~ ", SECTION 4. The Mayor shall sign and the Ci~y Cle~k shall attest to the passage of this ordinance. The City Clerk shall cause the sa~e to be p~blished once in the o~ficial newspaper within fifteen (15) days after its adoptior..
