AN ORDINANCE OF ~HE CI~Y COUNCIL
OF THE CITY OF SANTA MONICA ADDING
SECTION 4617 TO THE SAN'I'A I10NICA
MUNICIPAL CODC, REQUIRING NOTICE
TO TENAi'{TS OF CONDOHINIUn
CONVERSIONS.
SECTIO~ 1. Chapter 6 of Art~cle IV of the Santa Mon~ca
Mun~c~pal Code, relating to Rental Housing, is aI'lended to
include 'the following Section 4617:
Section 4617: NO'1'ICE OF CONDOMINm1 CONVERSION
(a) The owner of any exist~ng apartment complex for
wh~ch condonin1um conversion proceedings have been or are
hereafter initiated must give not1ce of such proceed1ngs to the
tenants therein. The notice shall indicate that condominium
converSlon proceedings have been init~ated and that the bUlldlng
or dwelling un1ts flay be sold as condomin1ums and the tenancy
terminated.

owner must give thlS notice ~n wr1tlng to each of
the exist~ng tenants and thereafter to each prospective tenant
pr10r to the executlon of a rental agreement. In addition,
said notice must be posted 1n a conspicuous, public place
on the premlses of the apartment complex.
(b) (I) Upon the failure of the owner to give
the notice required by this ordinance, the Director of
Planning is hereby authorized and empowered to notify the owner
of the violation of the nrovisions of this Code. said notice
shall be by reglstered mail addressed to said owner at his last
known address. A copy of said notice shall also be posted
on the property which is being converted.

(~) Upon the fallure of the owner of sald
property to cure the violation w1thin 10 days after notice has
been glven as herein before provided, the Dlrector of Plannlng
and his authorlzed representatives are hereby authorlzed and
empowered to enter upon said property to post the wrltten notlce
as is required by Subsectlon (a) and to mail a'written notice
to each tenant ln the apart~ent complex. The owner of said
property shall be charged a $500.00 fine; failure to pay sald
flne withln 40 days from the notice of violation shall result
in a lien belng placed agalnst the property.
SECTION 2. Any provision of the Santa Monlca
Munlclpal Code or appendices thereto inconsistent therewith,
to the extent of such lnconslstencies and no further, are
hereby repealed or modifled to that extent necessary to
affect the provlsions of thlS ordinance.
SECTION 3. If any sectlon, subsection, sentence,
clause or phrase of this ordinance is for any reason held
to be 1nvalld or unconstitutional by a decision of any
court of competent Jurisdlction, such decislon shall not affect
the validity of the remainlng portions of the ordinance.
The Clty Council hereby declares that it would have passed
this ordinance and each and every section, subsection,
sentence, clause or phrase not declared invalld or unconsti-
tutional without regard to whether any portion of the ordinance
would be subsequently declared invalid or unconstitutional.
SECTION 4. The ~iayor shall slgn and the City Clerk
shall attest to the passage of this ordinance. The City

Clerk shall cause the same to be publ~shed once in the
off~cial newspaper within fifteen (15) days after its
adoption. ~he ordinance shall become effect~ve after
thirty (30) days from its adopt~on.
