AN ORDINANCE OF THE CITY COIDJCIL OF
THE CITY OF SANTA MONICA EXTENDING
THE HQPATORIUM ON THE APPROVAL OF
PROCESSING OF CERTAI~ CONDOMINIUM
PROJECTS.
WHEREAS 7 the Planning Conm~ssion of the Clty of Santa
~ionica has found that the City's Condominium Code (Articles
IX, Chapter I, Sections 9122(A) through and including 9l23(F)
of the Santa Monica Munlcipal Code) merits comprehens~ve
rev~ew, technical refineMent and possible revl.sion to In-
corporate new plannlng cr1teria l.n Ilght of recent changes
2n the housing market; and
~7HERCAS, on April 10, 1979, the voters of the Cl.ty
of Santa r1.onica enacted Article X'JI II of the City Charter
to provide for a system of rent control in the City; and
WHEREAS, Article XVIII provides that removal of
controlled rental units froM the rental market for proposed
condom~nium projects shall be subject to approval of the
Fent Control Board; and
WHEREAS, the Clty Plann~ng COMmission recoMMended that
a full evaluation be conducted of the relatlonslnp bebleen
Artlc1e XVIII of the City Charter, State and local subdivislon
laws and the C1ty'S CondoffilnlUill Code and poss~ble revisl.ons
thereto; and
NHERR~S, since Aprll 10, 1979, a number of condom~nium
proJects have been flled for ~rocessing with the City Planning

Department that Lnvolve eLther converS2on of existing
apartnents to condo~inLuMs or removal of eXlsting dwelling
unlts to make way for new condominium constructlon; and
~mEREAS, the condorn2nium projects proposed ln sald
appllcatlons filed after Aprll 10, 1979, may be in conflict
with the conteMplated evaluatlon and revision of the City's
CondomlnlU~ Code; 'and
WHEREAS, the City CounCll of Santa Monica adopted an
emergency ordinance on Hay 8, 1979, creating a Moratorium
on the approval or processing o~ certain condomLnlUffi proJects
and said ordinance will be deemed repealed as of September 4,
1979.
1~lffiREAS, the City Plannlng COmffilssion has recommended
that the Clty Counell extend the moratorium for one hundred
eighty (180) days on the acceptance, approval or processlng
of permlts and appllcatlons for condoffilniun proJects which
lnvolve either conversion or renoval of existing dwelllng
units, as an interim measure pending co~pletlon of the study
of proposed reV1Slons to the Condo~lnium Code and ltS proper
relatlonship to the subdivLsion laws and Article XVIII of the
Clty Charter; and
WHEREAS, the City Council hereby concurs In and affirms
the flndlngs and recommendations of the City Planning
Co~m~sslon:

SECTIO~ 1. An extenslon is hereby Made of the moratorlUD
on the approval or processing of any applicatlon for approval

Department after April 10, 1979.
SECTION 2. An extension of the moratorlum is further
placed on the acceptance for processlng of any new applicatlons
for approval of a Tentative Tract or Parcel Map for a
condomlni~~ or commun~ty apartment proJect lnvolvlng elther the
converSlon or removal of controlled rental unlt(s) and filed
wlth the City Planning DepartMent after the effective date of
thlS ordlnance.
SECTION 3. An extenslon of the moratorlum lS further
placed on the approval or processing, pursuant to Santa Monica
MunlClpal Code Sections 9122(A) through 9l23(F), of any
applicatlons for approval of proposed condoMlnium stock
cooperative or communlty apartment proJects lnvolving the
conversion or removal of controlled rental unites} and
filed wlth the City Plannlng Depar~ent after Aprll 10, 1979,
or the acceptance for flllng of ne~ such appllcations after
the effective date of this ordinance.
SEC7ION 4. Th~s moratorlum shall not apply to the
acceptance, approval or processing of an application to develop
a condomlnium, CONffiUnlty apartment or cooperatlve apartBent
project if the existing rental un1t{s) to be demolished
or converted have rece1ved a declaratlon of exemption from
Article XVIII of the Charter, or a re~oval permit from the
Permanent Rent Control Board.
