A~ ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SAN~A MONICA
REPEALING SECTION 6500.269 OF
THE SANTA MONICA '1UNICIPAL CODE,
RELATING TO THE DISTRIBUTION OF
PROCEEDS OF SALES AND USE TAX.
v'1HEREAS, Section 6500.269 of the Santa Monlca 1'~unJ..c1pal
Code provldes that three-fourths of local sales tax ~oney
be deposlted and pald luto the general ~und of the Clty and
the remalnlng one-fourth of such monies be deposited ln a
Special Fund to be used only for capital improvements; and
WHEREAS, the City Councll flnds that 1t lS in the publlC
lnterest that all sales tax money collected be deposlted In
the General Fund:
~HE CITY C0UNCIL nF THE CI~Y OF SA~TA ~ONICA ORDAINS AS
FOLLOWS:
SECTION 1. Section 6500.269 of the Santa Honica !1un~cipal
Code, relatlng to dlstrlbutlon of proceeds of sales and use
tax, added by Ordlnance Number 939 CCS, adopted December 30,
1973, 1S hereby repealed.
SECTION 2. If any sect~on, subsection, sentence,
clause or phrase of this ordlnance is for any reason held to be
~nval~d or unconstitut1onal by a dec~sion of any court of
competent Jurisd~ctlon, such dec~sion shall not affect the
valldity of the remaln~ng port1ons of the ordlnance. The Clty
Council hereby declares that it would have passed this ordlnance
and each and every sectlon, subsectlon, sentence, clause or
phrase not declared lnvalid or unconstltutlonal without regard
to whether any portlon of the ordlnance would be subsequently
declared inval~d or unconstitutional.

SECTION 3. The Mayor shall slgn and the Clty Clerk
shall attest to the passage of thlS ordlnance. The r.ity Clerk
shall cause the sa~e to be published once in the officlal
newspaper wlthln fifteen (IS) days after 1ts adoption. The
ordinance shall become effect1ve after thirty (30) days from
its adoptl.on.
