O1120 '" ~ Santa ~lonica.allfornia e - ORDINANCE NO. ll20(CCS) (CITY COUNCIL SERIES) AN ORDI);ANCE OF THE CITY COU::\CIL OF THE CITY OF SANTA MONICA CALLING A SPECIAL MUNICIPAL ELECTION TO BE HELD ON JU~E 26, 1979 AND PROVIDING PROCEDURES FOR HOLDING OF SAID SPECIAL ~ruKICIPAL ELECTIO~ WHEREAS, Article XVIII, SectIon 1803(d) of the City Charter provides for the election of a five-member Rent Control Board at a spec~al election to be held within nlnety days of the adoption of saId ArtIcle XVIII; and WHEREAS, insufficient time exists to utilize the time frames provIded by the Election Code of the State of CalIfornIa to implement the procedures and publicatIons necessary to complete saId election; NOW, THEREFORE, THE CITY COUNCIL of the City Council of the City of Santa Monlca does resolve as follows: SECTION 1. ELECTION CALL. A Special MunICIpal ElectIon is hereby called to be held on June 26, 1979 for the purpose of electIng a fIve-member Rent Control Board. The two candIdates obtainIng the largest number of votes shall serve untIl the second Tuesday in April, 1985 and the remaining three shall serve until the second Tuesday In AprIl, 1983. The term of all members shall commence on the fIrst Tuesday follOWIng said election and each member shall serve until his or her successor 1S elected and qualifIed. Any ties in voting shall be settled by the castIng of lots. -1- ~ - e Santa MonIca, Ca1 i:_rna SECTION 2. ~OMI~ATION OF CANDIDATES. Candidates may be nominated not earlier than 8:00 A. M. on Monday, the 23rd day of April, 1979 and nominations shall close at 5:00 P.M. on FrIday, the 4th day of May, 1979. All other provisIons of the Santa MonIca Municipal Code and the ElectIon Code of the State of California pertaining to the nominatIon of candIdates for office shall obtain. SECTIOK 3. Cand1dates shall SUbWIt statement of Interest and deal1ngs In real property 1n a ~anner requIred bv la~ to the offIce of the CIty Clerk no later than ~:oo P.~l. on FrIday, the 4th day of ~ay, 1979. ~o candidate shall be a qua11fied candIdate for offIce unless saId statement 15 properly filed. SECTION 4. NOTICE OF ELECTION. ~ot earlier than FrIday, April 20, 1979 and not later than Friday, May 4, 1979, the CIty Clerk shall publish a notice of electIon as outlined In the ElectIon Code of the State of California. SECTION 5. BALLOT ORDER. Pursuant to Section 11214 of the Santa Monica Municipal Code, a drawing to determIne the ballot order of candidates is to be completed by the City Clerk WIthIn ten days of close of nominatIons and need not be at a regular City Council meeting. SECTIOK 6. POLLS. The polling places for saId election shall be open at 7;00 A.M. on the day of said elect10n and shall remain open continuously from 7:00 A.}[. until 7:00 P.M. on the same day when the polls shall close except as shall be otherwise provided by the Election Code of the State of California. -2- ~ ~, a Santa MonIca, calilltnia e SECTION 7. The City Council hereby authorIzes and dIrects that funds In the amount of $55,000 by approprIated from the unappropriated reserves of the General Fund of the City of Santa Monica for the purpose of defraYIng the cost of said Election and placed In the Electlon DIvision Account of the City Budget. SECTION 8. Pursuant to the provisions of Section 22003 of the Elections Code of the State of California, thIS City Council hereby requests the Board of Supervisors of saId County to permit the Registrar of Voters to prepare and furnish to said CIty for use In conductIng said election to be held on June 26, 1979, the computer records of the names and addresses of all elIgIble registered voters of said City In order that the City may prInt labels to be attached to self-maIler sample ballot booklets; and WIll also furnish to the Clty printed indices of the voters to be used by the Board at the polling place; and WIll make available to the CIty additIonal election eqUIpment and aSSIstance according to State law. That said City shall reImburse said County for services performed when the work is completed and upon presentation to the City of a properly approved bill. That the City Clerk is hereby directed to forward without delay to said Board of Supervisors and to said Registrar of Voters each a certI- fIed copy of thIS ordinance. SECTIO~ 9. ElectIon Services by Consultant. Pursuant to Section 10000 of the Election Code of the State of California, the City Clerk is authorized to contract with and reimburse ~art1n and Chapman Company for electlon services normally provided by an election consultant in connection with said Special Election. -3- i' .. e Santa MonIca, Cal~nIa e SECTION 10. As thIS ordInance relates to the conduct of an election, it shall be effective immedIately, pursuant to SectIon 619A of the City Charter. SECTIO~ 11. The Mayor shall sIgn and the City Clerk shall attest to the passage of this ordInance. The City Clerk shall cause this ordInance to be published once in the offiCIal newspaper of the City of Santa Nonica WIthIn fifteen days after Its adoptIon.
