AN ORDIN&~CE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA ADDING SECTION
10243 TO THE SANTA MONICA MUNICIPAL
CODE, LIMITING THE PERMISSIBLE NUMBER
OF LEASEHOLD INTERESTa ON THE SANTA
MONICA PIER.
WHEREAS, the C~ty Councl1 finds and declares that the
public welfare will be served by the malntenance of a d~versity of

ownership interests in bus1nesses on the~Santa Monica P1er;
THE CITY COUNCIL OF ~HE CITY OF SANTA MONICA ORDAINS
AS FOLLOWS:
SECTION 1. Section 10243 is added to Article X, Chapter
2 of the Santa Monlca Mun~clpal Code, to read as follows:

SECTION l0243. LIMIT ON INTEREST IN PIER LEASES_
No person shall hold or have any interest ln mo~e than
three (3) r1unlclpal Pler Leases. For purposes of this section, a
person has an 1nterest in a lease if the person, or his or "her
spouse, parent, child, brother. or sister, is named as lessee or holds
~ny share in an entlty named as, controlling, or subsidiary to a
lessee.
."

on any indlv:Ldual assoclation member.
This Section shall not apply to persons hold:Lng or having
an interest in more than thEBe (3) pier leases at the time of adop-
tlon of thlS ordlnance; prov~ded,~however, that such persons shall not
acqu1re any interests in additional pier leases unless and until they
hold or have an ~nterest ~n no more than two i2} of their ex~stlng
leaseholds.
SECTION 2. If any section, subsect:Lon, sentence, clause or
phrase of this ordinance is for any reason held to be lnvalld or un-
constltut1onal by a decision of any court of competent jurisdiction,
such decision shall not affect the valldity of the remalnlng portions
of the ordinance. The Clty Counc11 hereby declares that it would have
passed this_ord2nance and each and every section, subsectlon, sentence,
clause or phrase not declared inval1d or unconstitutlonal wlthout
regard to whether any portion of the ordinance would be subsequently
declared invalid or unconstitutional.
SECTION 3. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall cause
the same to be publlshed once in the off1cial newspaper within flf-
teen (IS) days after its adoption. The ordinance shall become effec-
tive after thirty (30) days from 1tS adopt1on.
