AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA AMENDING
CHAPTER 1, ARTICLE IX OF THE SANTA
MONICA MUNICIPAL CODE BY ADDING
THERETO SECTION 9127J RELATING TO
THE SCREENING OF PARKING AND STORAGE
AREAS IN CONNECTION WITH COMMERCIAL
OPERATIONS.
The City Council of the City of Santa Monica
does ordain as follows:
SECTION 1. Chapter 1, Article IX of the Santa
Monica Municipal Code is hereby amended by the addition
of Section 9127J to read as follows:
9127J. SCREENING STAND~RDS. The regu-
lations set forth in this section shall
apply in all Commercial Districts and in
adjacent residential areas in use for
parking, storage or other use in connection
with any commercial operation.
9127J.l. SCREENING VEHICLE PARKING AND
STORAGE AREAS. All areas devoted to vehicle
parking storage, service, repair, equipment
replacement, washing, polishing, painting and
similar uses, but not including display for
sale, lease or rental where automobile sales,
lease or rental are the principal commercial
business, visible from a public right-of-way
shall be screened in accordance with the
following requirements:

a. An open area of not less than 2
feet in depth measured horizontally
from the property line adjacent to the
public right-of-way shall be developed
and maintained in landscaping including
an automatic timer-controlled permanent
watering system; and
b. Permanent opaque landscaping, fencing
or walls shall be provided and maintained
at a height of not less than 3 feet above
the average adjacent grade at a distance
of not less than 2 feet measured horizontal-
ly from the adjacent public right-of-way.
In no case shall screening structures or
materials, with the exception of living
plants, exceed 6 feet in height above the
adjacent grade; or
c. In lieu of (a) and (b), such other
screening plan, design and materials approved
by the Architectural Review Board as satis-
factorily meeting the intent of these sections.
d. No screen required to be erected and
maintained by the provisions of this sub-
section shall be constructed within 5 feet
measured horizontally on either side of a
driveway aDtrance or vehicle access way opening
onto a street or alley which would impair
an unobstructed cross view of pedestrians
on the sidewalk, alley or elsewhere by motor-
ists entering or leaving. The unobstructed
areas shall not, however, exceed 10 feet
on either side of a driveway, entrance or
vehicle access-way.
9127J.2.REFUSE STORAGE AREAS. All outdoor
storage of trash, garbage, refuse and other items
or materials intended for discarding or collection
shall be screened on a minimum of three sides from
public view by a solid opaque impact-resistant
wall not less than 5 feet in height or, alternatively,
such other materials or design approved by the
Architectural Review Board.

9127J.3. STORAGE AREAS. All storage of
merchandise, wares, crates, bottles, or similar
items necessary to or part of a business or
commercial operation shall be screened from view
according to the provisions specified in 9127J.2.
9127J.4. MECHANICAL EQUIPMENT AREA. All mechani-
cal equipment shall be screened from view according
to the provisions specified in 9127J.3 except that
mechanical equipment enclosed in a housing or
cover meeting the intent and purpose of this
ordinance shall be exempt form the provisions of
this section.
9l27J.5. APPLICABILITY. The regulations here-
after set forth shall apply to all new construction
within the City of Santa Monica after the effective
date thereof and shall be applicable to all existing
commercial areas five (5) years after the effective
date thereof, the legislative intent being that
all commercial properties shall have complied with
these provisions five (5) years after the date of
their adoption.
SECTION 2. Any provisions of the Santa Monica
Municipal Code, or appendices thereto inconsistent herewith,
to the extent of such inconsistencies and no further, are
hereby repealed or modified to that extent necessary to
effect the provisions of this ordinance.
SECTION 3. If any word, section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to
be invalid or unconstitutional by a decision of any court

of competent jursidiction, such decision shall not affect
the validity of the remaining portions of the ordinance.
The City Council hereby declares that it would have passed
this ordinance and each and every word, section, subsection,
sentence, clause or phrase not declared invalid or unconsti-
tutional without regard to whether any portion of the
ordinance would be subsequently declared invalid or unconsti-
tutional.
SECTION 4. The Mayor shall sign and the City
Clerk shall attest to the passage of this ordinance. The
City Clerk shall cause the same to be published once in the
official newspaper within fifteen (15) days after its adoption.
This ordinance shall become effective after thirty (30) days
from and after its adoption.
