AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA AMEND-
ING CHAPTER 1 ARTICLE IX OF THE
SANTA MONICA MUNICIPAL CODE IN
RELATION TO BUILDING HEIGHT LIMITS.
The City Councl1 of the Clty of Santa Monica does
ordain as follows:
SECTION 1. Sect~on 9102 of Chapter 1, Art~cle IX of
the Santa Mon1ca Municipal Code relating to the deflnltion of
building heights is hereby amended to read as follows:
"Section 9102. BU1ldlng hel.ght is the
vertical distance measured from the average level
of the hlghest and lowest point of that portlon
of the lot covered by the build1ng to the h1ghest
point of the roof excluding those structures covered
by Sectl.on 9126B."
SECTION 2. Section 9l13Bl of Chapter 1, Article IX
of the Santa Monica Municipal Code relatlng to buildlng helght
in the CP Commerc~al Professl.onal Distrl.ct is hereby amended to
read as follows:
"Section 9l13Bl. BUILDING HEIGHT. The height
of any building or structure erected in thlS dis-
trl.ct shall be limited to six (6) storles or ninety
(90) feet except that buildlngs or structures in
excess of thlS liml.tation may be permitted by the

~ssuance of a Conditional Use Perrn~t under the
provis~on of Sectlon 9148 provided that:
(a) Approval of build~ngs or structures in
excess of six (6) stories and ninety (90) feet
in height but not more than twelve (12) stor~es
and one hundred sixty (160) feet in he~ght shall
be only on the basis of an Environmental and Flscal
Analysis sat~sfactorily demonstrating that no
significant adverse environmental or fiscal impacts
will occur as a result of the increased height.
(b) Approval of buildlngs or structures in
excess of twelve (12) storles or one hundred
sixty (l60) feet shall be only on the basis of
an Environmental and Flscal Analysis demonstratlng
that any and all portions of a bUl1ding or struc-
ture in excess of twelve (12) stories or one
hundred sixty (160) feet do not result in signlflcant
adverse impacts over and above those occurring at
the twelve (12) story, one hundred Slxty (160) foot
llmitationsi and, further that such additional al-
lowance will produce a demonstrated, measurable net
fiscal benefit to the Clty."
SECTION 3. Sectlon 91l4Bl of Chapter 1, Article IX
of the Santa Mon1ca Munlcipal Code relating to bUl1ding heights
in the CA Commercial Admlnistratlve Distr~ct lS hereby amended
to read as follows:

II Sectlon 9ll4Bl. BUILDING HEIGHT. The height

shall be limited to six (6) stories or ninety (90)
feet except that buildings or structures in excess
of this Ilmitation may be permitted by the issuance
of a Conditional Use Permit under the provision
of Section 9148 provided that:
(a) Approval of bu~ldlngs or structures in
excess of s~x (6) stor~es and ninety (90) feet
in helght but not more than twelve (12) stories
and one hundred Slxty (160) feet in height shall
be only on the basis of an Environmental and
Fiscal Analysis satisfactorlly demonstrating that
no significant adverse enVlronmental or flscal
~mpacts w~ll occur as a result of the increased
height.
(b) Approval of bUl1dings or structures in
excess of twelve (12) storles or one hundred Slxty

SECTION 4. Section 911BBl of Chapter 1, Article IX
of the Santa Monica Municipal Code relating to building heights
in the CR Commercial Recreational District is hereby amended
to read as follows:
"Section 9ll13Bl. BUILDING HEIGHT. Any buildlng
or structure erected in th~s district shall not
exceed 2 stories or 35' in helght."
SECTION 5. Section 9126D of Chapter 1, Artlcle IX
of the Santa Monica Municipal Code relating to walver of he~ght
limits is deleted in its entirety.
SECTION 6. Any provislons of the Santa Monlca
Municipal Code, or appendices thereto inconsistent herewith,
to the extent of such inconsistencies and no further, are hereby
repealed or modified to that extent necessary to effect the
prov~sions of this ordinance.
SECTION 7. If any sect1on, subsection, sentence,
clause or phrase of this ordinance is for any reason held to be
invalld or unconstitutlonal by a decision of any court of
competent Jurisdiction, such decislon shall not affect the
validity of the remain~ng portions of the ord~nance. The City
Council hereby declares that 1t would have passed th1s ordinance
and each and every section, subsect~on, sentence, clause or
phrase not declared invalid or unconstitutional w~thout regard
to whether any portion of the ordinance would be subsequently
declared inval~d or unconstLtutional.

SECTION 8. The Mayor shall sign and the Clty Clerk
shall attest to the passage of this ordinance. The C~ty Clerk
shall cause the same to be published once in the officlal news-
paper w~thin fifteen (15) days after its adoptlon. The
ordlnance shall become effective 30 days from and after adoption.
