The City Counc1l of the City of Santa Monica does
ordain as follows:
SECTION 1.
Chapte~ 6B of Article Xl of the Santa
Monica Municipal Code is hereby amended to read as follows:
"CHAPTER 6B - CONDOMINIUM AND COOPERATIVE TAX LAW
Section 6651. CONDOMINIUM TAX. A
condomin1UID business license tax is
imposed sclely for revenue purposes
upon the development and construct1on
of all condominium proJects, whether
of new construction or o~ conversion
from an existing building, in the sum
of One Thousand ($1,000) Dollars per
planned salable unit.

Section 6652. DEFINITIONS. In
~nterpret1ng and adm1n1stering the
provis1ons of th1s law, each of the
follow1ng words and phrases shall
be construed as herein set forth unless
1t 1S clearly apparent from the context
that a d1fferent meaning is 1ntended:
(a) CONDOMINIUM PROJECT. Any
condominium project or community apartment
project as so def1ned in Sect10n 9102 of
th1s Code or cooperative apartment proJect
defined as follows:
C~operative Apartment Project 1S
the ent1re parcel of real property,
includ1ng all structures thereon, on
which a cooperat1ve apartment is to be
constructed or an existing improved real
property is to be conv~rted to a co-
operative apartment.
Coo~erative Apartment is an
improved real property owned or leased
by a cooperative housing corporat1on or by
any other corporation, partnersh1p,
trust, or aSsoc1at1on if all orsu~-
stant1ally all of the shareholders of
such corporat1on, or partners of such
partnership, or benef1ciar1es of such

Section 6653. CONDOMINIUM LICENSE.

the City Clerk upon the payment of the
required fee provlded hereln or upon the
execution and recordatlon of a duly
notar~zed agreement slgned by all record
owners of the property contained wlthln
the condominium project, in a form approved
by the City Attorney, agreelng to pay the
condomlniurn llcense tax prior to occupancy.

against the property until it is pald~
withln flve (5) days of payment of said

Section 6653A. DEFERRAL OF CONDOMINIUM
TAX. The condomlnium business 11cense tax
may be deferred by the City Council with
regard to lndlvidual units in cooperatlve
apartments partlc1patlng in or assisted
by federal houslng programs for low and/or
moderate lncorne persons or where other
assurances are presented of the non-proflt,
non-speculative nature of the cooperative
apartment development, or units therein.
Such assurances may conslst of, but need
not be limlted to restrlctions on equlty
build-up and transfer thereof to promote
housing for low and/or moderate income
persons. The City Clerk shall record a
notice of deferral of taxes and the terms
thereof with the County RecQrder.
The City Councl1 may also defer the
payment of said taxes on cooperatlve
apartment units to be 6ccupied by, the

Section 6654. FAILURE TO QBTAIN

LICENSE m~LAWFUL. It is unlawful to engage
in, permit, suffer, or ass~st in the development
or construction or to 'QCcupy any condominium

for WhlCh a llcense has not been obtalned
as provided in th~s chapter.
Section 6655. TAX LIEN AND HEARING. In
the event that a developer fails to obtain
a condorn~nlum 11cense, the City Clerk shall
notify him that he is in violation and that
if he does not request a hearlng within
flve (5) days, a 11en will be filed against
the property being developed for the full
amount of the tax. In the event that a
hearlng 15 demanded, a properly noticed publlC
hearing will be set within ten (IO) days
of said request before the City Clerk, at
which time ev~dence may be presented to,

contest the 11en. The"contestant will have

a rlght to call witnesses and to cros~~

SECTION 2.
Sections 9l23C and 9123D of
Chapter I of Article 9 of the Santa Monlca Munlclpal Code
are amended to read as follows:

1. A Notlce of Intent To Convert
shall have been flIed with the City
Planning Department prior to the date of
fillng of the Tentatlve Tract Map, such
notlce to include a Comprehenslve
BUlldlng Conditlon Report prepared by a
BU11dlng Inspectlon Servlce or Slmllar agency
acceptable to the Buildlng Offlcer and Flre
Marshal contalnlng such lnforrnatlon as
is set forth on forms to be provided by
the Dlrector of Planning; present rent
scheduled, lncluding type and length
of tenancy; a llstlng of the proposed
lmprovements to be carr led and an
estlmated tlme schedule therefor; the
estlmated prlce range of the converted

units; and, a copy of the proposed
CC & R's for the completed proJect.
2. The City Planning Department
w~th~n s~xty (60) days after the fil~ng of
a Not1ce of Intent to Convert shall have
prepared and delivered to the applicant and
City Planning Comm1ss~on, a Convers1on
Report, includ1ng a staff recommendat1on for
approval or den1al. However, 1n no
event shall such recommendation for approval
or denial be based upon either present
rent schedules or the est1mated pr~ce range
of the converted unltS, including type
aRd length of tenancy; a I1sting of condlt1ons
or requlrements recommended as a basls for
approval or den1ali andl supportive reasons
or justiflcatlon for such recommendation.
3. The electr1cal, flre and life
safety systems of the structure, elther are,
or are proposed to ~e, in a condltlon of good
repair and ma1ntenanc~, includlng such
alterations for repairs as are requlred by
the BUlld1ng Offlcer.
4. The structure presently has, or is
intended to have, plumbing and sound
condltion, lndividual gas and electr1cal meters,

The appl~cants shall certlfy that such not1ce
has been given. Tenants who quallfy
or would quallfy at the tLffie of such Notice
under the cr1teria established for occupancy
by the proposed CC & Rls shall have the rlght
of flrst refusal for a perlod of thlrty (30)
days prlor to 'the tlme the unlt ~n which
they reslde lS offered to the general publlC
for sale and such tenants shall have the
rlght to purchase such a unlt prlor to its
offer to the general public thereby.
section 9123D. APPLICABILITY OF DEVELOPMENT
STANDARDS.
1. Other sections notwlthstanding,
no condomln~um converSlon shall be approved
untll all the condltions set forth In
Sectlon 9123C or lmposed by the Plannlng

2. All condomlnium projects of new
construction or conversion holdlng vested
rights as a condominium project as of
September 29, 1973, are exempt from
complying with the condominium development
standards set forth in Sections 9l23A and

9123B above.
SECTION 3.
Any provisions of the Santa Monlca
MunlCip~l Code, or appendices thereto inconsistent herewlth,
to the extent of such inconsistencies and no further, are
hereby repealed or moqified to that extent necessary to effect
the provisions of this ordinance.
SECTION 4.
If any word, section, subsection, sentence,
clause or phrase of thlS ordlnance lS for any reason held to
be invalid or unconstitutional by a decision of any court
of competent jursldlction, such decls10n shall not affect
the validity of the remaining portions of the ordinance.
The City Council hereby declares that it would have passed this
ordinance and each and every word, section, subsection, sentence,
clause or phrase not declared invalid or unconstitutional
without regard to whether any portion of the ordlnance would
be subsequently declared invalid or unconstitutional.
SECTION 5.
The City Council of the Clty of
Santa Monica finds and determines that the ordlnance as
hereby adopted is fundamentally declaratory of existlng law
and that the section is adopted in response to a Superlor
Court preliminary determinatlon that the condominium tax law as
orlginally adopted in some manner encroaches on powers exclusively
conferred upon the State. The City Council further declares

purely and absolutely pursuant to the taxing power which it
