OF THE CITY OF SANTA MONICA
AMENDING SECTION 21041(8) OF THE
SANTA MONICA MUNICIPAL CODE,
PERTAINING TO DISABILITY ABSENCE.

THE CI TY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Section 2l04I(8)'~f the Santa Mon1ca
Mun1c1pal Code 15 hereby amended and &hall read as follows:
8. An employee who 15 rece1v1ng
disability payments under the Worker's
Compensat1on Act of Callfornla shall,

unless 1ncreased or decreased by a
Memorandum of Understanding approved or
adopted by the City Council, receive-
the d1fference between the disability
payments under the Worker's Compensatlon
Act and full salary during the first
ninety days of such disability absencei

SECTION 2.
Any pr~isions of the Santa Monica
MunlClpal Coder or appendlces thereto ~pconsis~en~ herewith~
to the extent of such lnconslstencles and no further, are
hereby repealed or modlfled to that extent necessary to
effect the provisions of thlS ordin~nce.
SECTION 3. If any section, subsectlon, sentence,
clause or phrase of thlS ordlnance is for any reason held to
be lnvalid or unconstitutlonal by a decislon of any court of
competent )urlsdictlon, such declslon shall not affect the
validity of the remalning portlons of the ordinaftce. The
~
Clty Counell hereby declares that lt would have pas~ed thlS
ordlnance and each and every sectlon, subsection, sentence,
clause or phrase not declared lnvalld or unconstltutlonal
wlthout regard to whether any portlon of the ordlnance would
be subsequently declared lnvalld or unconstltutional.
SECTION 4.
Th~ Mayors~~l slgn and the City Clerk
shall attest to the passage of thlS ordinance. The City Clerk
shall cause the same to be publis~ed once ~n the offlclal
newspaper wlth~n fifteen (15) days after its adoptlon. The
ordinance shall become effectlve after thlrty (30) days from
its adoptlon.
