AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA, CALIFORNIA, APPROVING THAT CERTAIN
LEASE AGREEMENT ENTITLED "LEASE AGREEMENTu DATED
AS OF HAY 1, 1978, BETWEEN THE CITY OF SANTA
MONICA AND THE REDEVELOPMENT AGENCY OF THE CITY
OF SANTA MONICA
WHEREAS, the Redevelopment Agency of the C~ty of Santa
Mon~ca (the "Agency") proposes to acqu1re a certain s~te (the
"SiteU) w1thin the Downtown Redevelopment ProJect and lease the
s~te to the C~ty of Santa Mon~ca (the "City") for use as a publ~c
park~ng faci11ty, said lease to be dated as of May 1, 1978 (the
"Lease"), a copy of which ~s on f1le with the City Clerk of the
City; and
WHEREAS, the Agency proposes to finance such acquis1tion
through the issuance of revenue bonds pursuant to the Community
Redevelopment Law (Part I of Divis10n 24 of the Health and Safety
Code of the State of Californ~a), such bonds to be payable as to
pr1nc~pal and ~nterest from certa1n revenues ~ncluding the proceeds
of rents to be paid by the C~ty under the terms of sa~d Lease; and
WHEREAS, Article 9, Chapter 5, Part I, Divis~on 2, T~tle
5 (commenc~ng with Sect~on 54240) of the Government Code of the
State of Cal~forn~a requ~res that prior to enter~ng 1nto sa~d Lease
the City shall have approved it by ord~nance which shall be subject
to referendum;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Th~s Council hereby approves the Lease In
the form on flle wlth the Clty Clerk, provided that the amount of
annual base rent payable by the Clty thereunder shall not exceed
$354,000.
SECTION 2. SubJect to the provislons of Sectlon 1 and
subsequent to the effectlve date hereof, the Mayor 18 authorlzed
and dlrected to execute sald Lease and the Clty Clerk is authorlzed
and directed to attest thereto and to affix the offlclal seal of
the Clty thereto and to cause sald Lease, following executlon by
the Agency, to be recorded Wlth the County Recorder of Los Angeles
County.
SECTION 3. Any provisions of the Santa Monlca Munlcipal
Code, or appendices thereto lnconslstent herewith, to the extent
of such lnconslstencies and no further, are hereby repealed or modlfled
to that extent necessary to effect the provlsions of thlS ordlnance.
SECTION 4. If any sectlon, subsectlon, sentence, clause
or phrase of this ordlnance is for any reason held to be lnvalld
or unconstitutlonal by a decision of any court of competent Juris-
dlction, such decision shall not affect the validity of the remalning
portions of the ordlnance. The City Council hereby declares that it
would have passed this ordinance and each and every sectlon, sub-
sectlon, sentence, clause or phrase not declared lnvalld or
unconstltutional without regard to whether any portion of the
ordlnance would be subsequently declared invalid or unconst~tutlonal.

SECTION 5. The Mayor shall slgn and the city Clerk
shall attest to the passage of this ordinance. The C1ty Clerk
shall cause the same to be published once in the offlClal news-
paper withln fifteen (IS) days after its adoption. The ordinance
shall be come effectlve after thlrty (30) days from its adoptlon.
