SECTION 1.
Section 3201 of the Santa Mon4ca
,
Munlcipal Code is hereby amended to read as follows:
Section 3201. No person shall stand
or park any vehicle on any pub1lc
park1ng lot between the hours of
3:00 o'clock a.m. and 6:00 o'clock
a.m. whether said vehlcle is occupied
or unoccupied, without a valid permit

SECTION 2.
Sectlon 3201A is hereby added to the
Santa Monlca Municipal Code and shall read as follows:

Section 320lA. Beach Parkin9 Lot
~a,rking Permits. Any resldent of
the City living In a designated
permit area may make application
for a resident or guest parklng
permit for use at beach parking lots
during the tlmes that parking is
otherwise prohibited. Such parking
permits may be issued for a per~od
of up to one (l) year and shall be
processed by the Department of
Recreation and Parks. Permit fees,
lf any, designated permlt areas, and
exempted periods may be established
and changed, from tlme to time, by
resolution.
SECTION 3.
Section 3201B is hereby added to the
Santa Monlca Municipal Code and shall read as follows:
Section 3201B. Any person vlolatlng
any of the provis~ons of Section 3201
of the Santa Monlca Municlpal Code 'shall
be guilty of an lnfraction. Any person
convicted of an infractiQn under the
,
provlslons of ~aid Sectlon 3201 s~all
be punishable by a fine of not less than
Five ($5~OO) Dollars and not more than

Twenty-Five ($25.00) Dollars. Each
such person shall be guilty of a
separate offense for each and every
commission of any violation of any
provisions of Sectlon 320r of this
code and shall be punished accordingly.
In additlon to any other penalty
provided by law, any vehlcle parked
in violation of Section 3201 of thlS
code may be towed, at the owner's
expense, from the parklng lot and
impounded, and the owner thereof,
shall be responsible for any fees in
connectlon wlth such towing and
impounding.
SECTION 4. Any provisions of the Santa Monica
Municipal Code, or appendices thereto inconsistent herewlth,
to the extent of such inconslstencies and no further, are
hereby repealed ?r modlfled to that extent necessary to effect
the provislons of this ordinance.

SECTION 5~ If any section, subsection, sentence,
clause or phrase of this ordlnance is for any reason held to

be invalid or unconstitutional by a decislon of any court of
competent jurlsdiction, such decision shall not affect the
validity of the remaining portlons of the ordinance. The
City Council hereby declares that lt would have passed this

ordinance and each and every section, subsection, sentence,
clause or phrase not declared lnva1~d or unconstitutional
without regard tdwhether any pOrtiOn of the ordlnance would
be subsequently d~l~r~~ ln~alld<pr_~nconstitutional.

SECTION~6. The Mayor shaTI sign and the Clty Clerk
shall attest to the passage of thlS ordinance. The City Clerk
shall cause the same to be published once In the offlclal news-
paper Wlth1n fifteen (15) days after its adoptlon. The
ordlnance shall become effective after thirty (30) days from
lts adoptlon.
