AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
GRANTING A COMMUNITY ANTENNA
TELEVISION SYSTEM FRANCHISE TO
THETA -CABLE OF CALIFORNIA
THE CITY Or SANTA MONICA DOES ORDAIN AS FOLLOWS:

SECTION 1.
Pursuant to Resolution Number 4936
(City Council Series) a public hearing was held on October 25,
1977, at ~he hour of 7:30 P.M. in the Council Chambers of the
City Hall, on the appllcation of Theta Cable of California
(hereinafter called "Grantee"), fpr ?- commtU\j.ty. antenna

television system franChise. Said application w~s made
pursuant to Ord~nance ~umQer 734.adopted py the City. Council

of the City of Santa Monica on March 14, 1967, and all of the
terms .and conditions ~~ said Ordinance Number 734 are

~ncorporated herein as though fully set forth herein and
hereat and the Grantee must comply w1th the condit10ns thereof.
SECTION 2.
Grant of Franchise (Ra~es and
Servic~s). A franchise 15 herewlth granted'to the grantee
(Theta Cable of California) and the Grantee shall provide a
complete cable antenna television service for-the City of
San~ Monica including TV, FM, and auxiliary services as set
forth 1n Resolution No. 4936 (City Council Series) and in
accordance with the rates set forth therein.

SECTION 3.
Th2S ordlnance shall not become
effective until written acceptance thereof shall be filed
by the Grantee thereof w1th the City Clerk within ten (10)
days of the adoptipn o~ the ordinance gran~ing 'the franchise

Sections 14, l5A, and lSB of said Ordinance No. 734 (Clty
Council Ser~es).
SECTION 4.
Any provisions of the Santa Monica
Municipal Code, or appendices thereto inconsistent herewith,
to the extent of such inconsistencies and no further, are
hereby repealed or modified to that extent necessary to effect
the provisions of this ordinance.
SECTION 5.
If any section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to
be invalid or unconstitutional by a decision of any ~ourt of
competent jurisdiction, such declsion shall not affect the
validity of the remaining portions of the ordinance. The
City Councll hereby declares that it would have passed this
ordinance and each and every section, subsect~on, sentence,
clause or phrase not declared invalid or unconsti~utional
without regard to whether any portion of the ord~nance would
be subsequently declared invalid or unconstitutional.
SECTION 6.
The Mayor shall sign and the City
Clerk shall attest to the passage of thi~ ordinance. The
City Clerk shall cause the same to be published once in the
official newspaper withln fifteen (IS) days after its adoption.
