AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA AMENDING
SECTION 5228D OF THE SANTA MONICA
MUNICIPAL CODE, PERTAINING TO CHARGES
FOR COLLECTION OF REFUSE FROM POINTS
ON PRIVATE PROPERTY
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Sectlon 52280 of the Santa Monica
Munlc~pal Code lS hereby amended and shall read as follows:
"Section 5228D. RENTAL OF
RECEPTACLES FRO~! CITY. Notwithstanding
the provisions of Sections 5228, 5228A,
5228B, and 5228C, upon application by
the owner, manager or authorized agent
of the owner of any place of business,
multiple dwelllng, or apartment house
and upon the payment of the fees herelnafter
prescrlbed, the Director of Public Works
may provlde a metal bin or bins, insofar
as such receptacles are avallable at the
tlme of applicatlon, for the keeplng,
deposlt~ng, or accumulatlng of Class A
rubbish orlglnatlng on the premlses
descrlbed in the appllcation. The fee

hereby repealed or modif1ed to that extent necessary to
effect the provisions of th1s ordlnance.
SECTION 3.
If any section, subsection, sentence,
clause or phrase of this ordlnance is for any reason held to
be lnval~d or unconstltutional by a dec~slon of any court of
competent Jurisdiction, such declsion shall not affect the
valldity of the remalning portlons of the ordinance. The
Clty Council hereby declares that lt would have passed thlS
ordinance and each and every sect1on, subsection, sentence,
clause or phrase not declared lnvalid or unconstitut10nal
without regard to whether any portion of the ordinance would
be subsequently declared 1nvalld or unconstitutional.
SECTION 4.
The Mayor shall sign and the C1ty
Clerk shall attest to the passage of th15 ordinance. The
City Clerk shall cause the same to be published once ~n the
offlclal newspaper within flfteen (15) days after its adoptlon.
The ordinance shall become effectlve after thirty (30) days
from ltS adoption.
