THE CI,'l'Y OF SANTA MONICA AMENDING
SECTIONS 4114, 4115, 4136 OF, AND
ADDING SECTION 4122A TO, THE SAN~
MONICA MUNICIPAL CODE; PERTAINING TO
CONTROL OF ANIMAL NUISANCES"
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS:
SECTION L
Sectlon 4114 of the Santa Monica
Municipal Code is hereby amended and shall rec~~""s follows:

In addition to the penalties here~n
above provided, any cond~tlon caused or permitted to exist
~n vioaation of the provisions of this Section shall be
deemed a public nuisance and may be, by this City, summarily
abated as such, and each day such condition 'continues shall
be regarded as a new and separate offense.
SECTION 2.

Municipal Code is hereby amended and shall read as follows:
Section 4115. DoS~. Restricted Areas.
No person having control, charge or cust~y ox any dog shall
permit the same to,go'upon any scho~~~~UnC~zrecreation or
playground, or pUblic park, or upon those lands in the City
lYlng westerly of that certain thoroughfafe, commonly known
as The Promenade or upon the beach sands lying northerly of
the westerly prolongation of the center line 6~ealifornia
Avenue. Notwithstandlng any other p~ovi$ion of this Code,
any person violatlng t~is Section shall be guilty of an
infraction. Any person convicted of an infraction under
the provisions of this Sect~on shall be punishable by a fine

In add1tion to the penalties herein-
above provided, any cond1tion caused or p~rmitted to exist
in violation of the prov1sions of this Section shall be
deemed a pub-lie nuisance and may be,- by this City, summarily

be reqarded as a new and separate offense.-
The provisions .of this Section shall
not apply to dogs which have been especially trainei--and
u~ed for blind persons to a~d and guide them in their move-
ments, while such dogs are being used for such purposes.

Municipal Code is hereby amended and shall read as follows:
Section 4136. Doss To Be Controlled So As

ability to prevent the same, shall knowingly, carelessly,
or neg~igently permit any dog to commit any nuisance upon
any public.property or any impr~ved priva~e property other
than that of ~he owner of sa1d dog or person who has consented
thereto; provided that the foreg~ing.shall not apply to street
