Persons rece~ving funds from any publlc agency specifically for the payment of such utility taxes shall, l~keWlse, not be eliglble for the rebate provided for herein. (dl Every person ellglble for such, shall submit a claim for the rebate of the utilltles tax provlded for in thlS Chapter, and shall flle the same wlth the Dlrector of F~nance between May I and June 30 of each year for the taxes pald durlng the prevlous calendar year, commenc~ng with the calendar year 1976. Sald clalms shall be subm~tted on forms provided by the City and all statements made thereln shall be under oath and subJect to penalty of perJury. No rebate shall be pa~d under the provlslons of thlS sectlon unless the clalmant establlshes his right thereto by written record showlng ent~tlement thereto, and the Dlrector of Finance may requlre such addltlonal ev~dence as he deems necessary or approprlate ~n determ~nlng such ent~tlement. Only one cla~mant from each household each year shall be entltled to a rebate. (e) The Dlrector of Flnance shall review each clalm and shall cause a rebate to be made to the cla~mant of the utlllty taxes pald by such clalmant pursuant to this chapter, or that port~on of sald taxes pald which lS found to be due and oW~ng to the clalmant. Any claimant aggrieved by such a determination of the Director<'"6-f Finance shall have the right to appeal such determination to the License RevieW"'BOard wlthin ten (lO) days after the date of mailing of rejection of the claim Ioy'rebate by Dlrector OI Finance, and the decision of the License ReView Board shall be final. If an appeal by an aggrieved claimant is not taken within said ten (l~} nay period, no appeal of the decision of the Director of Pinance made thereafter be taken, and the determinatlon of the Dlrector of Finance shall become final. (f) If a claim for a rebate is ,not filed , . wlthln the per~on set forth in subsectiqn (d) hereof, all riqhts'to such rebate for the previous_ calendar year shall be waived, deemed void and permanently extingulshe~. SECTION 2. Section 6&34 is hereby added to the Santa Monica Municipal Code and sha~l read as follows: Section ~.63.4. Seve,ri3:bility. If any section, subsection; subdivision, paragraph, sentence, clause or phase of this chap~er or any part thereof is for any reason held to beun;ons~tuti6nal, such decision shall not affect the validity bf th,e remaining portions of this chapter or any i-:,. ~ ff part thereof. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be ~nvalid or unconstitutional by a decision of any court of competent jurisdiction, such decision snail not affect the validity of the remaining port~ons of the ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection,~ sente'ftce, clause or phrase not declared invalid or unconstitutlonal without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 5. The 'Mayor shall siqn a:nd the City Clerk shall attest to the passage Qt this ordinance. The City Clerk shall cause the same to be published once in the official news- paper within fifteen (~5) days after its adoption.
