OF THE CITY OF SANTA MONICA
REPEALING SECTIONS 11206 AND 11211,
AMENDING SECTIONS 11209, 11210,
11211, N~D 11214, OF, AND ADDI~G
SECTION 11208(a) TO 'I'HE SANTA
MONICA MUNICIPAL CODE PERTAINING
TO FAIR ELECTION PRACTICES.
THE CITY COm~CIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLONS:
SECTION 1. Seetlon 11206 of the Santa Bonica
Mun1cipal Code is hereby repealed 1n 1ts entirety.
SECTION 2. Sectlon 11211 of the Santa Monlca
Municlpal Code is hereby repealed in its entirety.
SECTION 3. Section 11209 of the Santa Monica
Munlc~pal Code is hereby amended to read as follows:
Section 11209. Limltat1.0ns on Contrlbutlons.
(a) No person other than a candldate when
contributing to his own campalgn shall make, and no campalgn
treasurer shall solicit or accept any contributlon which wl11
cause the total a~ount contrlbuted by such person with respect
to each election ltem, to exceeu One Hundred ($100) Dollars.
(b) The limlts stated ln (a) above are to be
adJusted in all years after 1974 for changes In cost of l~vlng.
(c) Except as provlded in ~l1210, no
contributlon shall be permitted except when the legal name
of the person or organization who offers the contr1butlon
1S disclosed. Contributions under assumed names or contr1-
butlons offered by indlvidua1s who are actlng as conduits or

agents for other individuals or interests are proh~b~ted.
(d) Expend~tures may be made by a propr~etor-
ShlP, flrm, partnershlp, jOlnt venture, syndicate, business
trust, company, corporatlon, associat~on, or labor un~on 1n
relatlon to candidates and measure w~thout lim1tat~on.
(e) No contribution may be glven by any
entity enumerated 1n subsection (d) hereof to a candldate or
any COrnIDlttee supporting sald candidate.
(f) In the case of a vote on a measure,
those entlties enumerated ~n subsection (d) hereof may contr~bute
not more than ($.04) cents multlplied by the votlng age
population.
SECTION 4. Section 11210 of the Santa ;'lonica
Municlpal Code is hereby amended to read as follows:
Sect~on 11210. Anonymous Contr~butions. The
total anonymous contr~butions to a candidate or committee WhlCh
1S to exceed in the aggregate $100 wlth respect to a Slngle
elect10n shall not be used by the candldate or committee for whom
lt was intended. To the extent that the total anonymous
contr~butions exceed that aMount the excess shall be forfelted
immed~ately to the City Treasurer. Where contrlbutlons are
recelved at a group event, the treasurer or representatlve of
the cand~date or comm~ttee at sa~d event, ~nsofar as is
pract~cable shall list the names and addresses of those persons
who contrlbute at sa~d event and shall certlfy as to the
accuracy of sald I1St and shall list the total contrlbut~ons
received at each such event.
SECTION 5. Section 11211 lS hereby aMended to read

Sectlon 11211. Printed Literature. All
Ilterature that is pr~nted by or on behalf of a candidate or
a cOffiffilttee, lneludlng, but not Ilmited to, snaIl cards and
blllboards, shall be identlfied wlth the names and addresses
of the printer, or chalrr:tan and secretary, or at least two
offlcers of the polit1cal group or organization on whose
behalf or order the same 1S printed. Such ldentlficatlon of
sald persons shall be printed legibly and shall be approprlate
to the Slze and type of the Ilterature, but in no event shall
such printing be less than in six (6) pOlnt type.
SECTIO:i 6. Sectloll 11214 of the Santa Honlca
Mun2cipal Code 28 hereby amended to read as follows:
Sectlon 11214. Ballot Order. In any electlon
for City Council, School Board of the Santa Monica Unifled
School Dlstr1ct or Board of Trustees of the Commun1ty College,
the order in which names shall appear on the ballot, shall be
determined by a casting of lots. The ballot number of all
candldates, propositions and ballot measures shall be the same
as the number WhlCh ~s drawn from said lots.
SECTIOLJ 7. Section 11208(a) 18 hereby added to the
Santa !ionlca Municipal Code to read as follows:
SectlOn 11208 (a). Late .F1ling,,!.ee. Any filing
requ~red to be made pursuant to Chapter 2 of Article 11 of the
Munic1pal Code which is not made on or before the date required
shall be subject to a late filing fee in the sum of Ten ($10)
Dollars per day for each day that said fll1ng is not made,
whlch fee shall oe assessed by the Fair Election Pract1ces
CommlsSlon and collected by the City Clerk; provlded, however,
that any such late fl11ng fee should not exceed One Hundred
($100) Dollars.

SECTION 8. Any provlsions of~the Santa Monlca
Mun1Clpal Code, or appendlces thereto 1nconslstent herewlth,
to the extent of such inconslstencies and no further, are
hereby repealed or modlf1ed to that extent necessary to
effect the provlslons of this ordinance.
SECTION 9. If any sectlon, subsectlon, sentence,
clause or phrase of th1S ordinance 1S for any reason held to
be ~nvalld or unconstitutional by a deC1Slon of any court of
competent jurisdictlon, such dec1sion shall not affect the
valldlty of the remaining port1ons of the ordlnance. The
City Council hereby declares that it would have passed thlS
ordlnance and each and every portlon of the ordinance would
be subsequently declared lnvalid or unconstitutional.
SECTION 10. The Mayor shall slgn and the Clty Clerk
shall attest to the passage of thlS ord~nance. The City Clerk
shall cause the same to be publlshed once in the officlal news-
paper within fifteen (15) days after its adoption. The ordinance
shall become effective upon adoptlon pursuant to Section 619
of the Clty Charter of the City of Santa Monica.
