O1044 r-- CA RLK:SI~cam 9-2-76 -.... - ORDINAi"\lCE NO. 1044 (CCS) (C~ty Counc~l Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SM~TA MONICA AMENDING THE DISTRICTING ~ffiP WHICH IS A PART OF CHAPTER 1, ARTICLE 9, SECTION 9103 OF THE SANTA MONICA MUNICIPAL CODE REGARDING THE WADSWORTH-HOLLISTER AND CENTRAL BEACH TRACTS. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. That the d~str~ct1ng map whLch LS attached to and made a part of Chapter 1, Art~cle 9, Sect~on 9103 of the Santa 110nica Hun~cipal Code ~s hereby amended as follows: The Wadsworth-Hollister and a port1on of the Central Beach Tracts that compr~se all of the property s~tuated between the North side of Wadsworth Avenue on the North, the North slde of Ocean Park Boulevard on the South, Neilson Way on the East, and Barnard Way on the West, 1nclud~ng all lots and parcels fronting on Wadsworth Avenue, Hart Avenue, Fraser Avenue, and the North side of Ocean Park Boulevard, wh~ch property 1S now des1gnated R-3 Multiple Res1dential Distr1ct lS hereby changed to R2R Mult1ple Res1dentlal Distr1ct. SECTION 2. The C~ty Counc~l f1nds and deter~ines that the publ1c necessity, conVenLence, general welfare and good zoning pract~ce requ1re that the amendment set forth 1n Section 1 be made. SECTION 3. Any prov1s1ons of the Santa Hon1ca Hunicipal Code, or appendlces thereto 1ncons~stent herew~th, to the extent of such inconsistenc~es and no further, are hereby repealed or modif~ed to that extent necessary to effect the provisions of th1S ordlnance. -1- r CA RLK:s:ltcam 9-2-76 e SECTION 4. If any sect~on, subsection, sentence, clause or phrase of th~s ordinance is for any reason held to be invalid or unconstitutional by a decislon of any Court of competent jurlsdlction, such decision shall not affect the validity of the remaining portlons of the ordlnance. The City Council hereby declares that ~t would have passed this ordlnance and each and every sectlon, subsectlonl sentence, clause or phrase not declared invalld or unconstitutional without regard to whether any portlon of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 5. The Uayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the offiClal news- paper wlthin fifteen (IS) days after its adopt~on.
